Title: Adoption of Ordinance for a Request for Easement Vacation of Utility and Drainage Easements in Pine Shadows Subdivision, Outlot A, Case of Alpha Development Background: The City Council is in the process of reviewing the final plat and site plan for Alpha Development and Legacy Christian Academy. The entire site encompasses what is now Pine Shadows Subdivision which has existing drainage and utility easements. If left in place, the easements would run through the middle of the platted lot and building location. In order to accommodate the proposed plat with the new drainage and utility easements, the existing easements would need to be vacated. Notification: In accordance with State Statute, City Staff attempted to notify property owners within 350 feet of the subject property of the public hearing to vacate easements. The City Council held a public hearing at the November 23, 2010 regularly scheduled City Council meeting. There were no public comments. Observations: A public hearing is required to eliminate the underlying drainage and utility easements that are a part of the original Pine Shadows Subdivision Plat. Recommendation: City Staff recommends introduction of the enclosed ordinance to vacate existing easements contingent upon the approval of the Final Plat and Site Plan. Funding Source: All costs associated with this application are the responsibility of the applicant. Council Action: Motion by to waive the reading of Ordinance # 10- per City Charter and Motion to adopt Ordinance # 10- to vacate certain drainage and utility easements in Pine Shadows Subdivision Outlot A, contingent upon the approval of the Final Plat and Site Plan.
