5. The sign shall be properly constructed and maintained in accordance with Section 117 -522 <br />(Construction Specifications) of the Ramsey City Code and Section 3107 of the International <br />Building Code <br />6. The dynamic display portion of the sign shall be operated in accordance with the provisions <br />found in City Code Section 117 -463 (f) (2). <br />7. That the Permittee shall comply with all other state and local permitting requirements for off - <br />premises signage along a state highway. <br />8. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br />9. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br />10. That the Permit shall be valid until September 28, 2015 or until such time that City Code is <br />amended to allow for permanent off - premises signage, whichever occurs first. <br />11. That if any provision of this Permit shall be declared void or unenforceable, the other <br />provisions shall not be affected but shall remain in full force and effect. <br />12. That this Permit shall not be considered modified, altered, changed or amended in any <br />respect unless in writing and signed by the City and the Permittee. <br />13. That if the Permittee, or its successors or assigns, violates any material term or condition of <br />this Permit, it is grounds for suspension or revocation hereof consistent with applicable law. <br />The motion for the adoption of the foregoing resolution was duly seconded by Mayor Ramsey, <br />and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Ramsey <br />Councilmember McGlone <br />Councilmember Dehen <br />Councilmember Look <br />Councilmember Wise <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />RESOLUTION #10 -09 -224 <br />Page 2 of 4 <br />
