2018422.003 Councilmember Look introduced the following resolution and moved for its adoption: RESOLUTION #10 -08 -192 I11111101110111100IIII10110101111IIII Record ID 2354577 RECD NOV 0 8 6110 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #0874 AND DECLARING TERMS OF PERMIT TO EXCEED SIGN RESTRICTIONS AS ESTABLISHED IN CITY CODE. WHEREAS, Dolphin Fast Food Inc. properly applied, for a conditional use permit to exceed sign size and location restrictions as established in City Code on the property generally known as 7245 Highway 10 NW and legally described as follows: That part of Lot 7 Auditors Subdivision No. 34 Anoka County, Minnesota described as follows: Commencing at the southeast comer of said Lot 7, thence northwesterly on the southwesterly line of said Lot 7 a distance of 770 feet, thence north and parallel with the east line of said Lot 7 and to the northeasterly line of said Lot 7, thence southeasterly on said northeasterly line a distance of 200 feet to the point of beginning of land to be described, thence continue southeasterly on the northeasterly line said Lot 7 a distance of 150 feet, thence south and parallel with the east line of said Lot 7 and to the southwesterly line of said Lot 7, thence northwesterly on said southwesterly line to a line drawn south from the point of beginning and parallel with the east line of said Lot 7, thence north and parallel with the east line of said Lot 7 and to the point of beginning (subject to easement of record if any) ( "Subject Property ") WHEREAS, the Planning Commission met on August 5, 2010, conducted a public hearing, and recommended that City Council approve the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #0874 a conditional use permit ( "Permit ") to exceed sign size and location restrictions is hereby granted to Dolphin Fast Food Inc. ( "Permittee "). 2. The Permittee is herein granted permission to erect one (1) directional sign on the existing ground sign on the Subject Property. 3. The gross surface area of the directional sign shall not exceed sixteen (16) square feet per face (thirty -two [32] aggregate square feet) and the height of the directional sign shall not exceed nine (9) feet above grade (to top of sign). 4. The installation of the sign on the Subject Property shall require a sign permit from the City of Ramsey (the "City "). The exact location, height, and configuration of the sign are subject to the approval of the City.
