of the outside storage area from the neighboring property. The Planning Commission held a <br />public hearing and reviewed the request on May 2, 2002. There was no public input during the <br />public hearing. The Planning Commission recommended that the City Council approve the <br />conditional use permit request by Tom Sauter. <br /> <br />Councilmember Kurak inquired if it was possible to add the type of screening in finding of fact <br />#3. <br /> <br />Community Development Director Frolik explained that the screening would be the additional <br />trees proposed on the north property line. <br /> <br />Councilmember Anderson inquired as to what was the justification for going from 10 percent of <br />outside storage to 31 percent. <br /> <br />Community Development Director Frolik replied that the property is located in the midst of a <br />heavily industrial district. If the property would have remained industrial there would have been <br />no restrictions. <br /> <br />Councilmember Anderson stated that it seemed odd that they would have approved an outside <br />storage paved area larger than what is permitted in City Code. <br /> <br />Community Development Director Frolik explained that the area was paved as a maneuvering <br />area and outside storage, but the outside storage was restricted. <br /> <br />Councilmember Zimmerman did not see anything wrong with the additional outside storage as <br />long as the screening is installed. <br /> <br />Tom Sauter noted that the north side of the property is already screened by the RJM Enterprise <br />building. <br /> <br />Councilmember Zimmerman inquired as to why staff felt there should be additional screening. <br /> <br />Community Development Director Frolik replied that staff was recommending screening due to <br />the types of equipment that will be stored, but it was a good point that the area simply faces the <br />back o[' a building. <br /> <br />Councihnember Hendriksen requested that the following be an additional condition: "That all <br />new or used equipment being stored on the property is in operating condition, which is being <br />sold in the course of H&L Mesabi's business and the storage of junk, debris, and inoperable <br />equipment will not be permitted." <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt <br />Resolution #02-05- adopting Findings of Fact # __ relating to a request fi'om Tom Sauter <br />for conditional use permit to exceed outdoor storage restrictions established in City Code. <br /> <br />City Council/May 14, 2002 <br />Page 23 of 33 <br /> <br />-70- <br /> <br /> <br />
