-164- <br /> <br />impact, Staff had a conversation with an individual at MnDOT who explained that their standard <br />for noise should be no more than 65 decibels during the daytime. Staff also had a conversation <br />with the MPCA to discuss what would be considered reasonable. Based on those discussions, <br />staff proposed that the best way to address the situation would be to have noise readings taken <br />from the site to determine what currently occurs and then based on those findings make a <br />decision regarding the soundwalt. <br /> <br />Councilmember Anderson replied that there is a reason the City constructed the soundwalls on <br />the other side of T.H. #47. <br /> <br />City Engineer Jankowski noted that the justification for that soundwall was the noise level. <br /> <br />Councilmember Anderson replied that the proposed development is across the road. <br /> <br />Mr. Lepper stated that a noise study was completed and the daytime measurements were below <br />the minimum standard, but the nighttime measurements did exceed the standard. Their plans are <br />to extend the berm along T.H. #47 to mitigate the noise to below the standard. <br /> <br />Councilmember Zimmerman inquired as to where the holding pond would be relocated to if the <br />berm is constructed. <br /> <br />Mr. Lepper reviewed the drainage of the site. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to approve the preliminary plat <br />of Birch Hill Lodge contingent upon compliance with City staff review letter dated November <br />30, 2001, the developer address MnDOT's request for identifying State Highway #47 fight-of- <br />way on the plat, resolving any issues with the Lord of Life Church regarding the extension of <br />Cobalt Street to their property and obtaining a rezoning, comprehensive plan amendments and <br />site plan approval, deleting from the preliminary plat proposal the center island in Cobalt Street <br />and revising the configuration of the intersection of Cobalt Street and the most northerly private <br />street in Block 2 of the plat in order to accommodate the turning of the City's Fire emergency <br />equipment as determined by the Fire Chief and elimination of the holding pond along Trunk <br />Highway//47. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Zimmerman. Voting No: Councilmember Hendriksen. <br /> <br />Case #5: <br /> <br />Request for Site Plan Review of Birch Hill Lodges; Case of Orrin Thompson <br />Homes <br /> <br />Community Development Assistant Wald stated that On'in Thompson Homes has applied for site <br />plan review of an 84-unit townhouse development. The property is generally located south of <br />Sunwood Drive and west of State Highway #47. The property is currently zoned B-I Business. <br />The applicant has requested that the property be rezoned to R-3 Urban Residential; which would <br />allow the property to be developed at a maximum density of seven units per acre. The City <br />Council introduced the rezoning ordinance at the December 11,2001 City Council meeting.
