-178- <br /> <br />Conformance with Plan. The Plat shall be developed pursuant to the Final Plat Plans <br />consisting of two (2) sheets, prepared by James R. Hill, Entitled Birch Hill Lodges. <br /> <br />Incorporation of All' City Code Requirements. That the recitals above and the <br />applicable provisions of the City Charter, Subdivision Code, Zoning Code and Public <br />Improvement Code of the CITY, as amended to date hereof, are incorporated herein by <br />reference. <br /> <br />Stage I Improvements Required. The improvements the CITY requires the <br />DEVELOPERS to construct within the Plat are as follows: <br /> <br />g. <br />h. <br />i. <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Streets with concrete curb and gutter <br />Trunk and lateral st6rm drainage facilities <br />Site grading and permanent erosion control <br />Natural gas <br />Telephone service <br />Electric service <br />Street lights (installment arranged by CITY during Stage I Improvements and <br />paid for by DEVELOPER as Stage II Improvement) <br />Sidewalks and Trails <br /> <br />Stage I Improvements'') <br /> <br />The DEVELOPER agrees to construct the Stage I Improvements according to the terms <br />and conditions of this agreement and in accordance with DEVELOPER'S plans <br />submitted to the CITY. Said plans shall be in general conformance with the Grading <br />Plan prepared by James R. Hill, dated February 21, 2001, revised The final <br />construction pIan.for the Stage I Improvements shall be 'in conformance with said plan <br />prepared by James R. Hill, dated February 26, 2002, revised The <br />DEVELOPER herein agrees to provide the CITY was a copy of the agreement signed <br />between the DEVELOPER and the Lord of Life Church fora grading easement being <br />requested by the DEVELOPER to grade onto a' portion of the Lord of Life Church <br />property. In the event that the DEVELOPER and the Lord of Life Church do not sign an <br />agreement for the grading easement being requested on the Lord of Life Church property, <br />the DEVELOPER must submit a grading plan to the CITY that will provide for the <br />construction of a retaining wall along the southeastern boundary line of the plat and is <br />subject to the City Engineers approval. <br /> <br />The DEVELOPER shall be responsible for completing the rough grading and providing <br />lot comer stakes prior to the installation of underground utilities. <br /> <br />Stage I Improvements Completion Date. The Stage ~ Improvements shall be <br />completed on or before April 1, 2003.
