-100- <br /> <br />8) <br /> <br />If the Permittee, or its successors, or assigns, violates any of the material terms of this <br />CUP is grounds for suspension or revocation hereof, consistent with applicable law. <br />Furthermore, the City specifically reserves the right to amend, suspend or revoke this <br />CUP consistent with applicable law as reasonably required to protect the public health, <br />safety and welfare and the environment. Specifically, but witlxout limiting the foregoing, <br />the City may amend, suspend or revoke this CUP consistent with applicable law if the <br />City Council reasonably determines that continued operation of the facility places the <br />public health, saiNt-y, or welfare, or the environment in jeopardy or creates a public <br />nuisance due to noise or other nuisance factors. <br /> <br />9) <br /> <br />In the event of property transfer, this CUP shall apply to the successors and assigns of <br />Jensen Ventures L.P., and an officer of Welch Companies shall provide the City with <br />written notice of same within 30 days oft he official date of transferring ownership. <br /> <br />10) <br /> <br />The City reserves the right to inspect the Subject Property for the purposes of conducting <br />inspections and obtaining necessary information pertaining to .the construction and <br />operational effect of the facility. Inspections shall be conducted during normal business <br />hours except in the event of an emergency.
