16. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash Contribution. The Plat is located in the Prairie Recreation District. Park. <br />dedication requirements shall be satisfied by a cash payment in the amount of Fifty Four <br />ThoUsand Four Hundred Dollars and no cents ($54,000.00) (32 lots x $1,700.00 per lot). <br /> <br />17. <br /> <br />Private Recreational Areas. The approved Site Plan prepared by Hakanson Anderson <br />Associates, Inc. and dated March 14, 2002, revision dated March 21, 2002, identifies two <br />private recreational areas for use by the residents of the Plat. The DEVELOPER shall <br />be responsible for the perpetual maintenance of these recreational amenities within the <br />Plat. <br /> <br />I <br />I <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />2i. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Trail Development Fees. The City Council has enacted a trail development fee in the <br />amount of Four Hundred Dollars and no cents ($400.00) per lot. Therefore, a payment in <br />the amount of Twelve Thousand Eight Hundred Dollars and no cents ($12,800.00) (32 <br />lots x $400/lo0 is due. <br /> <br />Trail Easement. The DEVELOPER herein agrees to provide the CITY with an <br />easement for future trail purposes, in recordable form and subject to the approval of the <br />CITY, parallel to T.H #47 from the north boundary to the south boundary of the Plat. <br /> <br />Sidewalk Construction. The DEVELOPER has proposed a neighborhood sidewalk <br />system that will connect to the City sidewalk system parallel to Sunwood Drive N.W. <br />The DEVELOPER shall be responsible to construct pedestrian ramps in locations <br />prescribed by the CITY, not to exceed 5% in grade, along Sunwood Drive. The costs <br />associated with sidewalk construction are not eligible as a credit towards the Trail <br />Development Fees and/or Park Dedication requirements due on the Plat. <br /> <br />Tree and Sod Planting Plan. The DEVELOPER herein agrees to install trees, shrubs, <br />and sod in accordance with the Landscape Plan dated August 30, 2001, revision date <br />March 21, 2002, and the Landscape Plan & Details dated March 11, 2002, revision dated <br />March 2 l, 2002, both prepared by Hakanson Anderson Associates, Inc. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />-198- <br /> <br />22. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br />introduction, and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties as well as mitigate the effects of construction activity on tree health, <br />within and outside of the Plat. The DEVELOPER, in order to protect trees from <br />construction damage shall: <br /> <br />a) Install physical barriers, such as snow fence, around trees that are to remain after <br /> initial grading.
