Inland Wetlands and Watercourses Com'n of the Town <br />of Old Saybrook, 124 Conn. App. 489, 2010 WL 3860434 (2010) <br />CONNEUIICUT (10/12/10) —This case addressed whether, when a <br />court finds an illegal condition in a zoning agency's decision is an inte- <br />gral component of the agency's decision, the agency can sever the illegal <br />condition and approve a modified application (rather than having a void <br />original application and requiring an entirely new application). <br />The Background/Facts: In January 2000, River Sound Development, <br />LLC ( "River Sound ") applied to the town's Wetlands and Watercourses <br />Commission (the "Commission ") for a wetlands permit. River Sound <br />sought to construct a country club and golf course. The construction <br />was to involve "32 acres of regulated activity ... for areas within 100 <br />feet of the wetlands boundary." <br />In July 2000, the Commission approved River Sound's wetlands per- <br />mit application. That approval was subject to several conditions.
