-118- <br /> <br />18. <br /> <br />plat and development agreement which authorizes the improvements using the following <br />equation: <br /> <br />The 'Overage' amount divided by the then cash per lot rate shall equal the number of lots that <br />shall be considered Park Dedication satisfied. This formula shall be used if the CITY <br />requires a cash payment in lieu of any park improvements to satisfy Park Dedication <br />requirements. <br /> <br />Concurrent with the applicable phase, both Woodland Green and Bear Parks will have six (6) <br />inch water services available. Woodland Green shall also have a sewer service stubbed out. <br />These utili.ty services will be provided at no cost to the CITY. Any sewer or water <br />improvements on the park land to be dedicated or the existing park land and beyond the street <br />right of way, may be considered a park improvement for purposes of Park dedication. <br /> <br />Also concurrent with any construction adjacent to the three park sites, the DEVELOPER <br />shall pave the trail links or concrete sidewalk connections. At the time of Final Plat approval. <br />for future phases of Highlands At River Park, the following park improvements will be <br />evaluated for satisfying the remaining cash Park Dedication due: <br /> <br />a) Parking lot at Bear Park <br />b) Ag lime infield at Bear Park <br />c) Irrigation for Bear or Woodland Green Park <br />d) Shelter adjacent to Woodland Green's play equipment <br />e) Trees and landscaping <br />f) Park signage <br /> <br />If the CITY demands a cash payment for any outstanding Park Dedication requirements, in <br />lieu of anticipated, improvements above, the DEVELOPER may appeal the matter to the <br />Park and Recreation Commission for a recommendation to the City Council. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Park Trail Development Fee. The City Council has established a traiI development fee in <br />the amount of Four Hundred Dollars and no cents ($400.00) per lot. Therefore, a payment in <br />the amount of Sixty Two Thousand Eight Hundred Dollars and no cents ($62,800.00) (157 <br />lots x $400/lot) is due to the CITY for this Plat and subsequent phases that would final plat <br />the entire 157 lots as reflected in the approved preliminary plat. All or a portion of this <br />obligation may be satisfied by the construction of trail improvements within or adjacent to <br />the Plat. <br /> <br />Concurrent with the watermain construction from Barium Street NW to the Plat, the <br />DEVELOPER shall construct an 8-foot wide bituminous trail from T.H. #47 to Roanoke <br />Street NW.
