-164- <br /> <br />proposes to develop 73 single family homes on the western part of the property, 152 townhomes <br />along Now-then Boulevard., and an 82 unit apartment building for senior citizens along <br />Dysprosium St. The current Comprehensive Plan identifies this area for commercial and single <br />family development. The March 2001 Dra~ Comprehensive Plan shows this area as being High <br />Density Residential along Dysprosium Street, Medium Density Residential along Nowthen <br />Boulevard and Low Density Residential on the western part of the property. The development <br />property is adjacent to property that is zoned R-1 Single Family Residential, with the exception of <br />a parcel north of the development property that is zoned R-3 Urban Residential, and a portion of <br />the Flintwood Hills P.U.D. that is adjacent to the southeast portion of the development property. <br />The Lord of Life Church property lying on the northeast side of Nowthen Boulevard is zoned B- <br />i, Business and the Savannah Oaks Senior Apartment Building on the eastern side of Dysprosium <br />is zoned M2,. Multi-Family Residential. A minor Comprehensive Plan amendment may be required <br />if the March 2001 Draf~ Comprehensive Plan is not adopted by Cky Council by the time their <br />proposal has completed all necessary reviews. The landscape plan meets the 20% open space <br />requirement for a Planned Unit Development. City staff has reviewed the landscaping plan as part <br />of the site plan review process. The initial landscaping plan was deficient. The developer is <br />working on a new landscaping plan to meet the City standards. The Planning Commission held a <br />public hearing in regards to the proposed rezoning on June 5, '2001. At, er review of the <br />application, the Planning Commission recommended that the rezoning application submitted by <br />Royal Oaks Realty be approved by the City Council. City Staff and the Planning Commission <br />recommended approval of the request for rezoning of the property from B-1 Business and <br />Single Family Residential to Planned Unit Development. <br /> <br />Councilmember Zimmerman inquired in regards to the 20 percent open space.. <br /> <br />Principal Planner Tmdgeon reviewed the open space that is proposed as pan of the development <br />noting that the City does not have an ordinance that excludes, wetland from being used as open <br />space. <br /> <br />Councilmember Kurak reviewed the language that is included in the March draf~ of the <br />Comprehensive Plan which addresses the use of wetland. She stated that she did not see <br />anywhere on the plan where any useable land is being kept open because she does not consider <br />front yards as open green space. She suggested stronger language to require more open space in <br />the development. <br /> <br />Councilmember Hendriksen reviewed the current ordinance. <br /> <br />Councilmember Anderson inquired as to what Comprehensive Plan the City would have to submit <br />a minor amendment for. <br /> <br />Principal Planner Trudgeon replied that he would have to research that information. <br /> <br />Councilmember Hendriksen stated that he did not see how the Council could amend something <br />the Council has not even adopted.
