-226- (the "Sub,~ect ProperS") WHEREAS, on December 14, 2001, the City of Ramsey received an application preliminar7 plat from the Developer, for a proposed plat; and WHEREAS, on December 14, 2001, the City of Ramsey received an application to rezone the subject property from R-I and B-l, to RI-U, R3-U, and Multiple Residential. WI3-E. REAS, on January 3, 2002, the Planning Commission revieWed the preliminary plat and recommended approval of the plat subject to certain conditions; and W~ERE. AS, on lanuary 3, 2002, the Planning Commission reviewed the application to rezone the subject property from R-I and B-I, to RI-U, R3-U, and Multiple Residential and recommended approval of the request; and WffEREAS, on lanuary 10, 2002, the Park and Recreation Commission reviewed the proposed plat and recommended that the that the park dedication be satisfied with a Combination of land dedication, cash, and trai/s; and NOW THEREFORE, BE IT RESOLVED BY TI~tE CITY COUN'C[L OF TI:IE CITY OF RAMSEY, ANOIC4. COUNTY, STATE OF M~i'NESOTA, as follows: That the Ramsey City CounciI hereby grants preliminary plat approval to Royal Oaks Realty, [nc for The Ponds subdivision subject to the following conditions: a) Compliance with City Staff'review letter dated December 31, 2001, Revised February 6, 2O02. b) The rezoning of the property from l~-t and B-I, to RI-U, R3-U, and N£ultiple Residential. c) 'Completion of a biological survey to determine the e,,dstence of Blanding's Turtles on the Subject Property The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the follqwing voted in favor thereof: and the following voted against the same: and the following abstained: ' and the following were absent: RESOLUTION #02-02- Page 2 of 3 I I I I I I I' '1 I I I I I I' I I I I I
