[DRAFT] construction until the Developer has submitted to the City a ~Letter of Credit, or alternative security authorized under Sedtion 12.4, in an amount equal to 125% of the City ~'s estimate of the cost of the portion of the mass grading and stormwater management system construction to be performed forthwith as a part of that phase. The Developer must also pay the inspection fee due under the City's Zoning Ordinance for the work to be performed in that phase and obtain the approval of the Lower Rum River Water Management Organization for the work to be performed in that phase. The Developer must satisfy the conditions precedent to its performance of the mass grading and stormwater management system construction for each phase and commence the mass grading and stormwater system management construction for that phase on or before the commencement date established in the Phasing Plan described in Section 4.2(a) and must complete such activities on or before the completion date set forth in the Phasing Plan described in Section 4.2(a). ARTICLE 11 DEVELOPER PUBLIC IMPROVEMENTS - LANDSCRAPING, PARK LAND IMPROVEMENT, PEDESTRIAN IMPROVEMENTS 11.1 LANDSCAPING ASSOCIATED WITH CITY PHASE I ROADWAY IMPROVEMENTS. The Developer must complete the installation of the landscaping associated with the City Phase I Roadway Improvements, as described in the Phase I Landscaping Plan referenced in Section 4-.g7.1 ( ) within __ months of the City's completion of the City Phase I Roadway Improvements. Upon the Developer's completion of such landscaping, the Developer must submit a guaranty [describe terms of Guaranty] and upon the City's receipt of such Guaranty, the City will release the teltevLetter of creditCredit, or alternative security authorized under Section 12.4, referenced in Section 4-.-.~7.1(__). 11.2 LANDSCAPING ASSOCIATED WITH CITY PHASE II ROADWAY IMt)ROVEMENTS. The Developer must commence the installation of the landscaping associated with the City Phase II Roadway Improvements, as described in the Phase II Landscaping Plan referenced in Section 4-.-.-.-.-.-.-.-.-.~7.8(d) within __ months of the City's substantial completion (exclusive of the final lift) of the City Phase II Roadway Improvements and must complete the installation of the Phase II Landscape Improvements on or before the date months from the City's substantial completion (exclusive of the final lift) of the City Phase II Roadway Improvements. Upon the Developer's completion of the landscaping described in the Phase II Landscaping Plan, the Developer must submit a guaranty ]describe terms of Guaranty] and upon the City's receipt of such guaranty the City will release the !e~erLetter of eredi~Credit, or alternative security authorized under Section 12.4, described in Section 7.8(d{2__). 11.3 COMMENCEMENT OF COMPLETION OF PARK LAND IMPROVEMENTS AND TRAILS. Developer must commence and complete construction of the park land improvements and the trails described in the Park and Trail Phasing Plan referenced in Section · 4-_37.1 ( ) above on or before the dates referenced in such Plan. On or before the commencement date for each phase of the Park and Trail Improvements, the Developer must provide the City with a left,Letter oferediK2redit., or alternative security, authorized under Section 12.4, in an amount equal to 125% of the Cie), Engineer's estimate of the cost of the parks and trails to be constructed as a part of that phase.
