[DRAFT] <br /> <br />~v-}-, RTC Ordinance"RTC Ordinance" means Section 9.20.31 of the Zoning <br />Ordinance, Which sets forth the land use restrictions and other zoning regulations <br />relating to the Subject Property. Subject to Section __. 4.8 below, the RTC <br />Ordinance also includes, any subsequent amendments, modifications or additions <br />to the version of the RTC Ordinance existing on the date hereof. <br /> <br />Owe~RTC Project. "RTC Project" means the Development of the Subject <br />Property in accord with the RTC Controls and other requirements of this Master <br />A~eement. <br /> <br />OexO-Secondam, Development A~eement. "Secondary Development AgTeement" <br />means an agn'eement between the C/U, and a Secondary Developer for the <br />Development of a Phase. A Secondary Development Agreement will specie, the <br />specific requirements for the Development of that Phase including, but not limited <br />to, the allocation of responsibility for the construction or installation of required <br />Public Improvements, provide for the Secondary Developer's delivery, of security <br />acceptable to the City pursuant to Section 12.4 below to secure the Secondary <br />Developer's construction and installation of any Public Improvements the <br />Secondary Development obligates the Secondary Developer to construct and <br />identJ~,ing approved plans and specifications for the Secondary Developer's <br />construction of private improvements on the Phase. <br /> <br />~Secondar¥ Developer. "Subject Property" means in the aggregate and jointly and <br />severally att of real property legally described on the attached Exhibit A. <br /> <br />~ TC-t. TC-2, and TC-3 Assessment Parcels. "Town Center District" means that portion of the City <br />consisting of five sub-distri cts created by and through the RTC Ordinance. <br /> <br />Town Center Review Board. "Town Center Review Bom'd" means the board to <br />be established pursuant to Section of the RTC Ordinance. <br /> <br />Wetland Act. "Wetland Act" means all local, state, County, City, and federal <br />laws and regulations relating to water and wetlands, including, but not limited to, <br />Section 404 of the Clean Water Act (33 U.S.C. t344), Minnesota Statute <br />Chapters 103A t!m'ough 103G, and all regulations promulgated pursuant thereto. <br />"Wetland Act" also includes ali additions, modifications and regxflations <br />subsequent to that version of the Wetland Act which exists on the date hereof. <br /> <br />Zonine Ordinance. "Zoning Ordinance" means Chapter 9 of the Ramsey City <br />Code, as m-nended from time to time. <br /> <br />10 <br /> <br /> <br />
