[DRAFT] <br /> <br />The Developer must provide the City with a detailed landscaping plan <br />s_peeificalh, describing the landscaping which the Developer will perform <br />within or adjacent to the rights-o%wav of the City Phase I Roadway <br />Improvements (the "Phase I Landscape Plan"). The Phase I Landscape Plan <br />must identih, a commencement date for the Developer's performance of the <br />work described in the Phase I LandsCape Plan. The commencement date <br /> <br />may be stated as a number of days followin.~ the City's substantial <br />co__mj~ietion of the Cit~, Phase I Roadway Improvements (exclusive of the <br />installation of the f'mal lift). The Phase ] Landscape Plan must also establish <br />a specific completion date for the Developer's performance of the work <br />described in the Phase I Landscape Plan. The completion date may be stated <br />as a number of days from the commencement date. The commencement <br />date may be stated as a number of days following the City's substantial <br />completion of the City Phase II Roadway Improvements (exclusive of the <br />installation of the final lift). The Phase II Landscape Plan must also establish <br />a specific completion date for the Developer's performance of the work <br />described in the Phase II Landscape Plan. The completion date may be <br />stated as a number of days from the commencement date. The Developer <br /> <br />will not be deemed to have satisfied this condition subsequent until the CRv <br /> <br />Engineer has approved the Phase II Landscape Plan. <br /> <br />The Developer must deliver a letter of credit for 125% of the Cit3, Engineer's <br /> <br />reasonable estimate of the cost of performing the work described in the <br />Phase I Landscape Plan. <br /> <br />The Developer must provide the City with a completed Pedestrian Plan <br />_a_ece_ptable to the Cit~, En~oineer and a Pedestrian Phasine Plan that <br />s_'pecificailv describes the phases in which the Developer will construct the <br />improvements described in the Pedestrian Plan. The Pedestrian Phasin~ <br /> <br />Plan must establish a schedule of commencement and completion dates for <br /> <br />the work in each phase. The DevelOper wiU not be deemed to have satisfied <br />this condition subsequent until the City En~oineer approves the Pedestrian <br />Plan and the Pedestrian Phasing Plan. <br /> <br />The Developer delivers to the City a Letter of Credit in an amount equal to <br />125% of the Citx Engineer's estimate of the cost of phase I of the Pedestrian <br />Phasing Plan. <br /> <br />1555730.red <br />V8 tp V6: <br />8/29/03 <br /> <br />13 <br /> <br /> <br />
