The <br />restriction must provide that in the event of a breach of the restriction the benefited part~,'s <br /> <br />sole remedy is to commence an action in Anoka CounW District Court to enioin any use of <br /> <br />the Cit3_' Hall Site which violates the restriction. <br /> <br /> 5.2 CITY MAINTENANCE OF CITY HALL SITE. Between the date the Developer <br />conveys the City Hall Site to the City and the date the City commences construction of the City <br />Hall Improvements or the date title to the City Hall Site reverts to the Developer pursuant to the <br />fight of reverter described in Section 5.1, the City shall maintain the City Hall Site in a neat, <br />clean and trirm~ed condition. If necessary, the City will seed the City Hail site to establish <br />~ound cover to prevent erosion. <br /> <br /> ARTICLE 6 <br />CITY PUBLIC IMPROVEMENTS - GRADING <br /> <br /> 6. l CITY PUBLIC IMPROVEMENTS - GRADING. The City must, at its expense, <br />final ~ade the public rights-of-way underlying the Ci~ Roadway Improvements and} i£the <br />City constructs the City Hall on the City Hall Site, the City Hall Site, as contemplated in the <br />Master Grading Plan. The City must undertake and complete its grading activities associated <br />with the City Roadway Improvements and the City Hall hnprovements in connection with and <br />within the timefl'ame set forth in this Master Agreement for the City's completion of the City <br />Roadway hnprovements and the City Hall Improvements, as applicable. <br /> <br /> ARTICLE 7 <br />CITY PUBLIC IMPROVEMENTS - CITY ROADWAY IMPROVEMENTS <br /> <br /> 7.1 CITY OBLIGATION TO CONSTRUCTION CITY ROAD WAY <br />IMPROVEMENTS. The City will construct the City Roadway improvements pursuant to this <br />Article 7. <br /> <br /> 7.2 DESIGN. The City will foahwithcommence design the City Roadway <br />Improvements: upon the Developer's satisfaction of the conditions subsequent described in <br />Section 4.2. The Developer has submitted proposed designs for the City Roadway <br />hnprovements to the City, and the City will consider these proposed designs in the City's design <br />process. V~en the City completes its design process for each phase of the City Roadway <br />improvements and before the City commences construction of that phase, the City will provide <br />the Developer with copi'es of plans and specifications showing the City's design for that phase <br />and will inform the Developer that the plans represent the final design plans upon which the City <br />intends to base its public bid specifications. The Developer shall have ] 0 days fi'om the receipt <br />Of the City's final desig-n plans to provide final comments to the City.
