-242- <br /> <br />No person may ride or drive a horse after sunset and before sunrise along or <br />crossing any public way without appropriate lighting or reflectorized <br />clothing. <br /> <br />The Council shall designate and properly post those areas in public lands <br />and parks where horses may be ridden. <br /> <br />No person may ride or drive a horse in any public park, beach, golf course <br />or other public property except w/~thin the right-of~way of public streets and <br />highways and areas duly designated by the City as a trail or hitching area. <br /> <br />Persons riding a horse or driving a horse-drawn vehicle upon a public road <br />way shall be subject to those provisions of the City Code and State Law <br />applicable to the driver of motor vehicles, except those provisions which by <br />their nature have no application. <br /> <br />Horses shall not be ridden or driven in any manner which would cause <br />undue damage to any hard-surfaced road. <br /> <br />No person shall ride or drive a horse upon private property without the prior <br />written permission of the owner or occupant thereof. <br /> <br />No person shall interfere with any horse ridden or kept in a lawful manner, <br />and owners of domestic animals shall restrain their animal so as to not <br />interfere. <br /> <br />Subd. 9. <br /> <br />Horse Care Commission <br /> <br />The Council hereby authorizes the establishment of a Horse Care <br />Commission to assist the Community Development Department in resolving <br />complaints from those persons aggrieved by horses, to investigate <br />complaints, to advise horse owners against whom complaints have been <br />lodged and to recommend to the Council appropriate action. <br /> <br />The Council shall appoint five persons to the Horse Care Commission, <br />including when possible a representative of the largest horse-oriented <br />association or club within the City and any other person who the Council <br />feels is qualified to serve. Two members shall serve a three year term, two <br />members shall serve a two year term, and member shall serve a one year <br />term. Any member is eligible for reappointment at the end of their term. At <br />least 4/5 of the Horse Care Commission shall be residents of the City. <br /> <br />The Horse Care Commission shall be a Commission of the City and as such <br />shall be required to keep minutes of its meetings and comply with the open <br />meeting laws of the State of Minnesota.
