-242- No person may ride or drive a horse after sunset and before sunrise along or crossing any public way without appropriate lighting or reflectorized clothing. The Council shall designate and properly post those areas in public lands and parks where horses may be ridden. No person may ride or drive a horse in any public park, beach, golf course or other public property except w/~thin the right-of~way of public streets and highways and areas duly designated by the City as a trail or hitching area. Persons riding a horse or driving a horse-drawn vehicle upon a public road way shall be subject to those provisions of the City Code and State Law applicable to the driver of motor vehicles, except those provisions which by their nature have no application. Horses shall not be ridden or driven in any manner which would cause undue damage to any hard-surfaced road. No person shall ride or drive a horse upon private property without the prior written permission of the owner or occupant thereof. No person shall interfere with any horse ridden or kept in a lawful manner, and owners of domestic animals shall restrain their animal so as to not interfere. Subd. 9. Horse Care Commission The Council hereby authorizes the establishment of a Horse Care Commission to assist the Community Development Department in resolving complaints from those persons aggrieved by horses, to investigate complaints, to advise horse owners against whom complaints have been lodged and to recommend to the Council appropriate action. The Council shall appoint five persons to the Horse Care Commission, including when possible a representative of the largest horse-oriented association or club within the City and any other person who the Council feels is qualified to serve. Two members shall serve a three year term, two members shall serve a two year term, and member shall serve a one year term. Any member is eligible for reappointment at the end of their term. At least 4/5 of the Horse Care Commission shall be residents of the City. The Horse Care Commission shall be a Commission of the City and as such shall be required to keep minutes of its meetings and comply with the open meeting laws of the State of Minnesota.
