CASE <br /> <br />INTRODUCE ORDINANCE AMENDING CHAPTER 7, SECTION 7.13 OF THI~ <br />RAMSEY CITY CODE ENTITLED PAWNBROKERS <br /> By: James Way, Sergeant, Ramsey Police Department <br /> <br />Background: <br /> <br />The Ramsey City Code, Chapter 7, deals with licenses; Section 7.13 deals specifically with the <br />licensing of pawnbrokers. Upon review of paragraph 7.13.06 entitled Holding of Property, staff <br />has concern with the sentence "No personal property deposited with or purchased by a licensee <br />shall be sold or permitted to be redeemed from the place of business of licensee until five (5) <br />days after the copy of the records required by City Code Section 7.13.04 have been made <br />available to the Chief of Police, except upon written permission of the Chief of Police." What <br />staff disagrees with is the five days. Staff is recommending increasing the five days to 30 days, <br />which would allow the Police Department time to receive reports of possible stolen items. <br /> <br />There are recent cases in the City of Ramsey and the City of Anoka where it was determined that <br />the property that was taken in by the pawn dealer wagstolen but was not discovered until after <br />the five day waiting period. The City of Anoka amended their ordinance on November 16, 200t, <br />to the 30 day time period. <br /> <br />Staff has written a letter to Mr. Nissen of Ralph's Guns and Pawn explaining this proposed <br />change. If Council would introduce this ordinance tonight, and formally adopt it at the next <br />Council meeting, this amendment would be effective on or before March 1, 2002. <br /> <br />Council Action: <br /> <br />Motion to introduce an ordinance amending Chapter 7 Licensing and Permits, Section 7.13 <br />Pawnbrokers, Paragraph 7.13.0~6_6.~olding of Property, to increase the number of days a pawn <br />shop has to hold items~';~e (5)~ays to thirty (30) days. <br /> 1 <br /> <br />Reviewed by: x cd'fi/ _ , <br />Sergeant Way <br /> <br />Police Chief <br />City Administrator <br />City Attorney <br />City Clerk <br /> <br />CC: 01/08/02 <br /> <br />-205- <br /> <br /> <br />
