Commissioner Henke noted that this case was brought to the meeting at the request of one <br />Commissioner. She suggested it should be determined by the rest of the Commission whether <br />we even want to pursue it. She stated she would like to see a case put on a subsequent agenda <br />pertaining to how items get put on the agenda. <br /> <br />Commissioner Childs .questioned if Commissioner Deemer thinks there is a real benefit to the <br />Commission reviewing this entire chapter. <br /> <br />Commissioner Deemer responded that these are the rules we are operating under and we should <br />understand them. <br /> <br />Commissioner Swanson asked if Commissioner Deemer means he wants to review the Statute <br />and use it as a guiding document. <br /> <br />Commissioner Deemer stated he is concerned that the Commission all read and understand this <br />Statute the same way. <br /> <br />Attorney Goodrich offered that he also has a guide from the Minnesota League of Cities that he <br />could get out to the Commission. <br /> <br />The Commission determined that there really isn't anything to debate with regard to State Statute <br />410. <br /> <br />Commissioner Deemer reiterated that he feels it is a benefit for the Commission to read and <br />discuss this. <br /> <br />Motion by Commissioner Henke and seconded by Commissioner Ebel that the City Attorney <br />furnish the Charter Commission with the Study Guide from the LMC and that the <br />Commissioners could bring questions back about the Guide to the next meeting along with <br />Chapter 410 <br /> <br />Motion carried. Voting Yes: Chairperson Vogt, Commissioners Henke, Ebel, B.ertzyk, Childs, <br />Deemer, Milless and Swanson. Voting No: None. Absent: Commissioner LaMere. <br /> <br />Motion by Comrnissioner Henke and seconded by Commissioner Deemer to place a case on a <br />subsequent agenda and discuss how agenda items are placed on the agenda. <br /> <br />Motion carried. Voting Yes: Chairperson Vogt, Commissioners Henke, Deemer, Bertzyk, <br />Childs, Milless and Swanson. Voting No: None. Absent: Commissioner LaMere. <br /> <br />Commissioner Deemer inquired if Chapter 14 of the City's Charter has been determined <br />manifestly unconstitutional, how do we get it out of the Charter.
