(M.S.A. 410.10. ) The Constitution provides <br />that a proposed charter can be adopted by such majority as the legislature <br />may prescribe. The majority needed for adoption of a new charter~ as now <br />prescribed by law is 51 percent of those vdting en the question at the election, <br />except 55% is required to remove or amend charter provisions establishing <br />liquor patrol limits. <br /> <br />Certification of charter. (M.S.A. 410.11.) If the charter is adopted,~the <br />city clerk must file copies in the office of the Secretary of State, the office <br />of the Register of Deeds, and his own office. Each copy must be accompanied <br />by a certificate attesting to its accuracy and giving the date of 'the election <br />and the vote by which the charter was adopted. While the Constitution and laws <br />do not require it, it is exceedingly desirable .that the charter commission <br />retain at least one copy of the charter itself, and that printed copies be sent <br />out as follows: Two or more to the League of Ninnesota Nunicipalities~ 300 <br />Hanover Building~ 480 Cedar Street~ St. Paul, ~N 55!01, one to the Ninnesota <br />Historical Society~ St. paul; one to the Public Affairs Library, 365 Blegen Hall, <br />University of Ninnesota,.~inneapolis, 55455; one to the. State Library, Capitol~ <br />St.Paul; one or more to the local city library; one to the clerk of the district <br />court for the county. Not only will these copies be frequently referred to in <br />~hese various places~, but the city will gain a good name from a fairly liberal <br />policy in the distribution of its charter. The League can prOfitably use <br />several copies to send on library loan to other Ninnesota charter co~ssions <br />considering new charters. <br /> <br />Charter in effect. Succession. (N.S.A. 410.11.) Assuming that the certifi- <br />cates mentioned above have been deposited, the new charter will take effect at the <br />end of. thirty days from the date of the election or at such other time as is <br />fixed in the charter. It supersedes the previous charter of the city, if any, <br />the courts are~required to. take judicial notice of it~ and the officials.elected <br />and appointed under it may take o#er the control of the city's records, money, <br />and property at any time specified' therein.'
