CASE # <br /> <br /> AUTHORIZATION FOR SALE <br /> OF PROPERTY TO <br />ANOKA COUNTY COMMUNITY ACTION PROGRAM (ACCAP) <br /> <br />By: William K..Goodrich, City Attorney <br /> <br />Background: <br /> <br />At its February 27, 2001 meeting, the Council introduced an ordinance to permit the sale of the City <br />owned property at the intersection of T.H. 47 and the soon to be built Sunwood Drive extension. <br />This is approximately 11.2 acres which is the subject of the February 18, 1999 purchase agreement <br />between the City and ACCAP. As Council is aware, ACCAP has commenced a lawsuit seeking <br />specific performance of the purchase agreement and/or damages from the City. The sale ordinance <br />may now be considered for final adoption. <br /> <br />Enclosure: <br /> <br />Sale ordinance <br /> <br />Recommendation: <br /> <br />Staff recommends adoption of the enclosed ordinance together with a motion to authorize the City <br />Administrator and the Mayor to execute the necessary documents to close this transaction pursuant <br />to the terms of the February 18, 1999 purchase agreement. The second motion should be subject to <br />ACCAP executing the proper legal documents fully dismissing its pending lawsuit concerning tl~s <br />subject. <br /> <br />Council Action: <br /> <br />Motion to adopt an ordinance authorizing the sale of Lot 1, Block 1, Sunwood Estates and Outlot A, <br />Sunwood Estates <br /> <br />AND <br /> <br />Motion to authorize the Mayor and City Administrator to execute the necessary legal documents to <br />sell Lot 1, Block 1, Sunwood Estates and Outlot A, Sunwood Estates pursuant to the terms of the <br />February 18, 1999 purchase agreement between the City and ACCAP which sale authorization is <br />CONTINGENT upon ACCAP dismissing with prejudice that certain lawsuit entitled: <br /> <br />-195- <br /> <br /> <br />
