Case #8: Request for a Conditional Use Permit to Construct a Monopole Telecommunication Tower; Case of American Tower Corporation Principal Planner Trudgeon stated that the City received an application from American Tower Corporation to construct and operate a 175-foot monopole telecommunication tower for Ver/zon Wireless on the property located at 14165 Ramsey Boulevard, which is owned by Bruce Volk. At the January 23rd City Council meeting, the Council tabled a decision on the matter until American Tower Corporation provided more information on why the proposed antenna could not go on the new water tower being constructed on Sunwood Drive. The applicant has waived the 60-day rule in order to explore options for the location of its tower. They are investigating the new water tower site as a possibility for the location of the Verizon antenna. At this time, the 'applicant would like to keep the original application open until it can be determined that the water tower location can serve Verizon's needs. Case #9: Direct City Attorney to Review January 23, 2001 Proposed Charter Amendment Petition and Report on Sufficiency City Administrator Norman stated that the City Council received a proposed Charter Amendment petition during the regular City Council meeting of January 23, 2001. According to State Statute, the City Council is obligated to schedule a special election if the petition meets all the requirements. The special election must be held within a 90-day period. The City Clerk has reviewed the petition signatures and determined that the required amount of sig-natures are registered voters and it is in order to file for a special election. The next stop in the process is to have the City Attorney review the proposed amendments to Chapter 5 of the City Charter to determine if it is in compliance with the State Statutes and the State Constitution. Motion by Councilmember gmderson, seconded by Councilrnember Kurak. to direct the City Attorney to review the proposed Charter Amendment petition to determine if it is in compliance with State Statutes and State Constitution.
