CASE #

REQUEST TO RECONSIDER RESOLUTION CALLING FOR SPECIAL ELECTION
By: James E. Norman, City Administrator

Back~round:

During the Council meeting of December 19, 2000, the City Council authorized a resolution
calling for a special election to adopt an ordinance establishing density and transition standards
for new residential development. The City received a letter, dated December 21, 2000, from
Barry A. Sullivan, who represents Ramsey resident Ben Deemer (letter attached to case). Mr.
Sullivan requested that the City Council reconsider the resolution passed on December 19, 2000,
and determine to cancel the special election. Mayor Gamec asked that this item be added to the
Council agenda for discussion and consideration.

As part of this same topic, Councilmember Hendriksen has asked that any reconsideration of the
special election also include discussions on Charter implications. The two major areas of
concern Councilmember Hendriksen has asked to be discussed include the ramifications of not
holding the special election called for on December 19, 2000, and the broader question of the
City's obligation to adopting an ordinance that was passed as a voter referendum Charter
amendment in September 1997. Staff will ask the City Attorney to respond to these questions.

Council Action:

Based upon discussion.

Reviewed by:

City Administrator
City Attorney

Copies also distributed to:
City Clerk

CC:'01/09/01

-329-
