-38- <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Green Space Requirements Along Highway #47; <br />Case of Lyndale Terminal Co. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:01 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearin~ <br /> <br />Chairperson Nixt called the public hearing to order at 7:01 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that Rick Foster of RF Development and Victor <br />Sacco of Lyndale Terminal Company have submitted a request for a variance to the landscape <br />requirements adjacent to public roads. Mr. Sacco is proposing to develop a Holiday Station store <br />in River's Bend 3rd Addition at the intersection of Xkimo Street NW and T.H. #47. City code <br />requires a 20-foot wide landscaped yard adjacent to all public roasts. However, in 1980 the City <br />granted a 25% variance to lot sizes and setbacks for all commercial uses in River's Bend. This <br />variance was granted in lieu of property dedicated for public purpose (Rum River Bridge-. <br />corridor, T.H. #47 right-of-way, Rivers Bend Park). The 20-foot landscape' requirement is <br />basically a parking lot setback. Therefore, based on the City's agreement with Mr. Rick Foster <br />in 1980, the 20-foot landscape requirement adjacent to T.H. #47 in River's Bend 3ra Addition is <br />reduced to a 15-foot requirement. The fight-of-way dedicated in 1980 for future improvements <br />to T.H. #47 widens in the vicinity of Xkimo Street and T.H. #47..As a result, the developers of <br />the Holiday site cannot provide the 15 foot landscape requirement adjacent to T.H. #47 without <br />reducing the amount of green space that is being proposed adjacent to Xkimo Street NW. A <br />calculation of required and proposed landscaped yard has been provided by the developer and <br />identifies that the requirement is either met or exceeded along X/Omo Street. It was staff's <br />opinion that any reduction of the green space along Xkimo Street is unacceptable because of the <br />single-family residential use on the east side of Xkimo Street. In addition, there will be at least <br />20 feet of green space along T.H. #47. However, it will be 'on MnDOT's right-of-way, not on the <br />Holiday site. city staff recommended approval of the variance request. Ms. Frolik noted that the <br />variance would be contingent upon achieving site plan approval. <br /> <br />Citizen Input <br /> <br />Board Member Kociscak inquired as to how many feet the site plan is deficient of green space. <br /> <br />Community Development Director Frolik reviewed the site plan. <br />Chairperson Nixt inquired if there was any safety concerns or any reason to receive comments <br />from MnDOT. <br /> <br />Community Development Director Frolik explained that MnDOT has received the site plan and <br />has not made any comments pertaining to green space. <br /> <br />Board of Adjustment/December 5, 2000 <br /> Page 2 of 6 <br /> <br />I <br />I <br />I <br />i <br />I <br /> <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />i <br />I <br /> <br /> <br />
