The haul route for the excavated material will be as follows: Between Lots 21 and 22 of the proposed plat of St. Andrews Addition; then across the aoif course property to the northern bounda9' of the railroad right-of-way; then east to 1~3a Avenue N.W. and then onto T.H. #10. Approximately 34,000 cubic yards of this material may be hauled eastward down 153r~ Avenue N.W. for the construction of I$3rd Avenue N.Vv'./155m Avenue N.W., or onto property' lying south of 153~d Avenue N.W. within the Northfork P.U.D. Trucks shall be required to add a su~'lcient number of axles when travel on roads constructed to less than 9-ton standards is required to meet a 7 ton per axle road. All grading operations shall be conducted between 7:00 a.m. and 7:00 p.m. on weekdays only unless othem, ise specifically approved by the City. Administrator and'or his designee. The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gusts exceed 30 miles per hour. 22. All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Fedex:al and Environmental Protection Agency regulations for the protection of water quality. 23. Alternative haul roads are subject to the approval ofthe City Engineer. While hauling operations are in progress, the permit holder shall maintain the haul road in a condition satisfactory to the City Engineer. When hauling operations are completed, the permit holder shall either restore that haul road to a condition at least equal to that which existed at the time the hauling operations were started, or compensate the local road author/ty in an amount satisfactory to that road authority and concurred in by the City Engineer for the restoration of that haul road. The City Engineer will then accept such restoration or concur in such financial settlement for the restoration of the haul road in writing Md such acceptance will relieve the permit holder of any additional obli..ation in connection with the restoration of the haul roads. If the permit holder fails or refuses to perform haul road restoration or to make satisfactory financial settlement for such restoration, the City, will cause the restoration work to be done and require reimbursement from the financial guarantee required herein. The motion for adoption of the foregoing resolution was duly seconded by Councilmember ~ and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same and the following abstained and the following were absent whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the __ day of March, 2000.
