I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # <br /> <br />CONSIDER ACTION ON THE ANOKA COUNTY COMMUNITY ACTION PROGRAM <br />(ACCAP) REQUEST TO DEVELOP <br /> A MULTI-FAMILY RENTAL HOUSING PROJECT IN RAMSEY; <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />The Anoka County Community Action Program had applied for a rezoning, site plan review and <br />subdivision approval to do a multi-family rental housing project on the west side of T.H. #47 at <br />the intersection with Sunwood Drive N.W. The property is located on the west side of T.H. #47 <br />at the intersection with Sunwood Drive N.W. The cases were on the November 28, 2000 City <br />Council agenda. <br /> <br />With respect to the rezoning, the City Council adopted findings of fact. The motion to introduce <br />the rezoning ordinance failed. Any final action on the rezoning, site plan and subdivision was <br />tabled in order to give the City Attorney sufficient time to research whether or not failure to <br />introduce the rezoning ordinance applies as a denial under the interpretation of the State 60 day <br />rule. <br /> <br />Observations: <br /> <br />The application for rezoning was received on October 18, 2000 and under the 60 day rule, the <br />City had until December 15 to render a decision. The City exercised its option to invoke a 60 <br />day extension to give the City Attorney time to perform the necessary research. The new <br />decision deadline is February 13,2001. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site Location Map <br />b) Planning Commission meeting minutes dated November 6, 2000 <br />c) City Council meeting minutes dated November 28, 2000 <br />d) Findings of fact adopted by City Council on November 28, 2000 <br /> <br />Recommendation: <br /> <br />The City Attorney will be prepared to make a verbal presentation and recommendation at the <br />meeting. <br /> <br />Council Action: <br /> <br />Will be based on discussion with the City Attorney. <br /> <br />Reviewed by: <br />City Administrator <br /> <br />Copy to: <br />City Attorney <br /> <br />CC: 01/01/23 <br /> <br />-217- <br /> <br /> <br />
