is being relocated by the City further west to an area proposed to be platted as Gateway North
Industrial Park No. 5. Ali 4 lots in the proposed plat exceed the 1 acre minimum tot size and 200
foot lot width reqmrements. The plat will receive public access from 141s~ Avenue'and Ebony'--
Street. The plat will be serviced with municipal services. .~,-'~-' · ·
'
Citizen Input -:? :'~" '~, '%

Jeff Schatt- St. Paul Terminals d/b/a Danny's Tranny's - 14050 Basalt Street N~W. - Stated tl/i~it:!
for the past 2 years, St. Paul Terminals has been in the process of:bringing th~ scrap yard into
compliance with the conditional use permit. They are trying toerun an effi~cient, clean operation.
Their operation is on Lots 1, 2, 3 and 4, Block 4, Gateway N°rth:industrial"Park 2 and they were
approached several months ago by the City's appraisor,,r~garding ex[ending 141s~ Avenue as a
public street and City services between their lots 1 and J' ai~'d until noW,:'~e¥ have heard nothing
more. They are concerned that the noise and visua!' :.aS~ects,:0f the scrap yard will become an
issue fbr businesses developing west of their site in the ne~ industrial 'parkl '~ It appears that the
City is approving a plat with no access because what is suppc~e~ t.o, be 14t~ Avenue is private
property that has not been acquired. In addition, if 141~ were extended as public street to the east
to intersect with Basalt, a very expensiv,,e scale and building access at. Danny's 2~ranny's would
have to be moved as the easement fights are,~within 6 inches of their building. Stated a desire to
know what the City's plans are becaUSeit. _. impa'c_ts_ their business plan. Mi-2... _,Schaat also noted that
he would not have known about this meeting if Mr: Kars't hadn't told hiTM. 'Mr. Schaat stated that
he doubts the City knows how fnuch had.taken place--on {he site s{:nce they purchased it from
Karst. They have been working quite ~losely with.."~ka C3(in¢' to bring the operation into
compliance and that has been quite costly...f~_ ,~',:~:?'~' ....

Chairperson Nixt ~tated that Danny's Trann(;"S'iS under a conditional use permit which runs with
the land and the City cannot revoke the permit Unless the Permittees are not in compliance with
the terms.0fthe permit. .;_ ;:; ::._..

It was.noted that the City-does have control OVer a portion of property that is proposed to plat
141~ Avenue't6. the west and it ~s from tkis'~e~tion of 141~' that the plat will have public access.

--:( ::~.
._ 7--M_r~'Schatt stated that afiother critical issue is that their scrap yard is supposed to be operating on
j.,...i :~ %i); Lot !, but has expanded t0~ Lots 2, 3 and 4. After they complete their site clean up, they
were planning to approach the ~ity within a year for a conditional use permit amendment to
legalize the use. of Lots 2, 3 and 4. This problem was inherited with the purchase of the property
from Dan Karst. St. Paul' ~'enninals wants to operate the right way and are concerned that the
process to legalize the use of Lots 2, 3 and 4 may be an issue next year with their new neighbors.

. i~ .' .Chairperson NiXt replied that if St. Paul Terminals is engaging in a use that requires a conditional
".~ use permrt; he would encourage them to continue to work with the City. The City is not out to
putpeople out of business, but we do want to protect our interests.

Ms. Frolik noted that because St. Paul Terminals is purchasing the property on a contract for
deed, Mr. Karst is still listed as the fee title owner and that is why the hearing notice was sent to
Planning Commission/January 2, 2001

-24-
