The applicant mov~~ t0' }~h~';i~i~::ofRams'ey in 1984 andi~i:&~'been maintaining <br /> horses on the property since:then. ~¢. surroundinglP~c,el.s~ rang? i~':~size fi:om 2.5 acres to <br /> approximately ten acres and mo~t prop'~ owners in:thd ~kf6vcn'h°rses. The horse ordinance <br /> that was in effect in 1984 when the appl~i~aht moy~d.:~::ihe d~]i:~0~i~amsey required residents to <br /> own three acres per horse. The horse ordiixance'W:~~ rewrit~i, li, fi~1987 and currently states that <br /> on parcels between L5 .and three acres tw'~h0~:~ are permitted with a conditional use permit. <br /> The leased pasture-ar~a is located to the s~ of the applicant's property. The applicant has <br /> stated that the~e:i~ a fenced'~ath leading ~'~'~ ~ <br /> from;her h6inestead to the leased pasture area to allow <br /> the horses-~'0ption to ro~m- between the t~ P~i~'erties. City Code does not address how <br /> leased property affects the:~n~mber of horses:;_~)roperty owner is permitted to maintain. It is <br /> staff'S._:und~standing that Ms. Dahlheimer:~otild like to maintain a total..of four horses on 5.9 <br /> acres, this includes the'oWned and le~ed'i'~mperty. Current City Code would allow seven horses <br /> on a 5.9 acre par6e[ if the applicant ownd~:the entire acreage, four under the proposed amendment <br /> ~:~c[ur~ent[y in review~'::Themanure produced by the horses is dispersed to surrounding neighbors <br /> "~nd- k'Pread on the subjeC~ property, City Code requires barns to be set back a distance of 50 feet <br /> from dwellings and 75 feet! from property lines. The 2.5 acre parcel contains a 30 foot by 55 foot <br /> (1,650 square feet) barn that is located approximately 64 feet fi:om the nearest property line..The <br /> applicant alsddhas a round pen area for the horses on the 2.5 acre parcel. It is staff's <br /> understanding ~hat the horses have been maintained on the 2.5 acre parcel since 1980. <br /> Maintaining h6i'ses on the property is compatible with the characteristic of the neighborhood and <br /> .consistent w, iih~surrounding uses. Staff reconnnended approval of the conditional use permit <br />.... contingent..~apon the applicant providing verification that 3.4 acres is being leased from the <br /> adjacent'neighbor.
