-262- <br /> <br /> WHEREAS, all versions of the draft ordinance recognize that compliance with the literal <br />interpretation of the density transition requirements contained in the City Charter may not be <br />reasonable or feasible in all cases; and <br /> <br /> WH?REAS, all versions of the draft ordinance propose to waive the density transition <br />requirements on parcels that were zoned for densities higher than single family as of October 22, <br />1997; and <br /> <br /> WHEREAS, all versions of the draft ordinance contain a provision wherein the owners <br />of adjacent lands can waive the density transitioning requirement on the common property line <br />with their respective parcels when they feel i.t is unnecessary or impractical; and <br /> <br /> WHEREAS, the configuration of the Subject Property is such that literal application of <br />the City Chatter density transition requirements is not possible, the Subject Property was zoned <br />for multi-family housing prior to October 22, 1997, and the City has not received any verbal or <br />written comments of opposition to the development proposal from any of the owners of the 10 <br />parcels adjacent to the Subject Property, <br /> <br />NOW THEREFORE, BE Il' RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />l) <br /> <br />That the R.amsey City Council recognizes that the 36% reduction in allowable units per acre <br />in the dc~'elopment proposal for the Subject Property appears to meet the spirit of the City <br />Charter language pertaining to density transitioning and hereby grants preliminary plat and <br />site plan approval to Orchard HiIls in accordance with relevant City Codes, contingent upon <br />compliance with the City Staff Review Letters dated December 1, 2000, revision date <br />January 3, 2001. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember __ <br /> , and upon v.'~te being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this day of February, 2001. <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />City Administrator <br /> <br />RESOLUTION #01-02- <br /> Page 3 of 3 <br /> <br /> I <br /> ! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
