-28- Residential. Cathleen Artman is proposing to establish a massage therapy business in her home. Cathleen is a certified and insured massage therapist who will be the sole employee and expects to service a n-taximuln of five clients per week. She iS requesting to service clients Monday - Saturday with operation hours of 9:00 a.m. to 9:00 p.m. Cathleen would rnainly be servicing fi'iends, family, and neighbors. Mrs. Artman does not intend to advertise her business or take ill any clients that she does not know on a personal basis. City Code restricts home occupations to 20% of the gross floor area of the home. The room where the home occupation will be established is 144 square feet (t2 x 12), which equates to approximately .04 % of the gross floor area. The City has issued Conditional Use Permits for home occupations in the past. City staff recomrnended approval of Cathleen Artman's request for a conditional use pelTnit to operate a massage therapy service in her home. The Plmming Commission reviewed the conditional use perrnit request at their regular meeting on November 6, 2000. A resident expressed concern during the public hearing as to whether or not signage of the business and parking along the street would be permitted. The proposed conditional use pem~it prohibits any interior or exterior signage of the proposed business and off-street parking must be proved by the applicant. The Plarming Commission recommended approval of Cathleen Artman's request for a conditional use permit to operate a message therapy service in her home. Councihnember Anderson inquired if the applicant would be agreeable to including iii the conditional use permit that if she were to no longer live on the property the conditional use permit would terminate. Cathleen Artman, 14651 Neon Street NW, Ramsey, replied that she would agree to those tenThS. City Attorney Goodrich stated that as long as the applicant is agreeable to those ten-ns then it can be placed in the conditional use permit. Motion by Councilmember Zimmerman, seconded by Councihnember Connolly, to adopt Resolution #00-11-306 adopting Findings of Fact #0539 relating to Cathleen Artrnan's request for a conditional use pelrnit for a massage therapy service in her home. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmennan, Cmmolly, Anderson, and Hendriksen. Voting No: None. Motion by Councilmember Cormolly, seconded by Councilmember Zimmerman, to approve Mrs. Artman's request tbr a conditional use permit for a home occupation located at 14651 Neon Street with the additional wording to condition #2 ".:.however the applicant has agreed that the permit will expire upon ceasing the use of the property for primary residence.", based on the findings of fact and adopting Resolution #00-11-307 declaring terms of same.
