No building permit for the Site will be issued until the Permittee has: a) signed and returned this Development Permit; and b) provided the City with a copy of the Grading and Drainage Permit issued by the Lower Rum River Water Management Organization No Certificate of Occupancy for the structure will be issued until the Required Improvements, or a financial surety for same, are accepted by the City. 10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before December 31, 2001. 11. RECOGNITION OF LOCATION. As a continuance of the economic development efforts expended between the City and the Permittee in conjunction with the development of this site, the Permittee herein agrees to recognize Ramsey as the City of location on all forms of advertising and business correspondence whenever reasonably prudent to do so. 12. ESCROW CHARGES. The City and Permittee herein agree that the standard forms of financial guarantee to ensure the installation of the Required Improvements and are hereby waived. The Permittee herein agrees that the tax increment payments from the City to the Permittee described in Section 2.2 of this Contract shall serve as financial guarantee that the Required Improvements will be installed in accordance with City specifications and in a timely manner. In the event the Permittee fails to construct and install the Required Improvements as required herein, the City may complete the Required Improvements as required herein, the City may take the actions provided in the development agreement to cure the default. 13. UTILITY CHARGES. The standard utility charges (sewer and water trunk and lateral fees and stormwater management fees) are not the responsibility of the Permittee. The standard utility charges shall be reimbursed to the City as described in the development agreement between the City and the Permittee. 14. OUTSIDE REGULATORY AGENCIES. The Permittee herein agrees to be responsible for obtaining all required permits or licenses from any other regulatory agencies. Sharp and Associates, LLC, hereby acknowledges receipt of this permit and that they have reviewed the conditions of and have agreed that they will comply with the terms of this permit.
