-112- <br /> <br />will be provided only if all property taxes, City fees and charges on the property are <br />current. <br /> <br />Om <br /> <br />REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site will be <br />issued until the Permittee has: a) signed and returned this Development Permit; and b) <br />provided the City with a copy of the Grading and Drainage Permit issued by the Lower <br />Rum River Water Management Organization No Certificate of Occupancy for the <br />structure will be issued until the Required Improvements, or a financial surety for same, <br />are accepted by the City. <br /> <br />10. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before December 31, 2001. <br /> <br />11. <br /> <br />RECOGNITION OF LOCATION. As a continuance of the economic development <br />efforts expended between the City and the Permittee in conjunction with the <br />development of this site, the Permittee herein agrees to recognize Ramsey as the City of <br />location on all forms of advertising and business correspondence whenever reasonably <br />prudent to do so. <br /> <br />12. <br /> <br />ESCROW CHARGES. The City and Permittee herein agree that the standard forms of <br />financial guarantee to ensure the installation of the Required Improvements and are <br />hereby waived. The Permittee herein agrees that the tax increment payments from the <br />City to the Permittee described in Section 2.2 of this Contract shall serve as financial <br />guarantee that the Required Improvements will be installed in accordance with City <br />specifications and in a timely manner. In the event the Permittee fails to construct and <br />install the Required Improvements as required herein, the City may complete the <br />Required Improvements as required herein, the City may take the actions provided in the <br />development agreement to cure the default. <br /> <br />13. <br /> <br />UTILITY CHARGES. The standard utility charges (sewer and water trunk and lateral <br />fees and stormwater management fees) are not the responsibility of the Permittee. The <br />standard utility charges shall be reimbursed to the City as described in the development <br />agreement between the City and the Permittee. <br /> <br />14. <br /> <br />OUTSIDE REGULATORY AGENCIES.
