I

CASE #:

ADOPT ORDINANCE REGARDING COMMERCIAL TOWER SETBACKS
By: Principal Planner Patrick Trudgeon

Background:

During discussion regarding the Tower Overlay District, the City Council instructed staff to draft
an additional amendment to the newly adopted tower ordinance. Specifically, the Council asked
that the setback for towers in residential districts be changed from 1 ½ times the height of the
tower from dwellings to ½ times the height of tower from property lines. The City Council
reviewed the proposed draft at its February 13, 2001 meeting and requested that one additional
change be made to the proposed ordinance. Specifically, language allowing for lesser setbacks
for towers if a licensed engineer can prove that the collapse of a tower will occur within a lesser
distance than the required setback is now being taken out. The City Council introduced the
ordinance subject to staff making the aforementioned change.

Observations:

In accordance with the City Charter, the ordinance is now eligible for adoption.

Recommendation:

City Staff recommends adoption of the enclosed ordinance.

Council Action:

Motion to adopt Ordinance #01- to create the Tower Overlay District.

Roll Call Vote:

Councilmember Terry Hendriksen
Councilmember Susan Anderson
Councilmember Patti Kurak
Councilmember Jerry Zimmerman
Mayor Thomas Gamec

Review Checklist:
Community Development Director
City Attorney

CC: 02/27/01

q

-197-
