'1 I I I I I I I I I I I I I I I I PROPOSED ORDINANCE #01- CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AMENDMENT TO CHAPTER 9 OF THE CITY CODE, WHICH CHAPTER IS KNOWN AS THE ZONING AND SUBDIVISION OF LAND CHAPTER OF THE CITY CODE. AN ORDINANCE AMENDING SECTION 9.15 (TOWERS) OF THE CITY CODE OF RAMSEY, MINNESOTA. The City of Ramsey ordains: SECTION 1. AMENDMENT Subsection 9.15.08 (b) and (c), Tower Setbacks, is amended to include the following language: In Business and Industrial Zoning Districts, towers shall meet the setbacks of the underlying zoning district with the exception of industrial zoning districts, where towers may encroach into the side-or rear setback area, provided that the side or rear property line abuts another non-residential zoned property and the tower does not encroach upon any easements. Towers constructed within Residential Zoning Districts shall maintain a minimum setback equal to 1.5 times the height of the tower from any lot line. SECTION 2. REPEAL Subsection 9.15.08 (d) shall be amended to repeal the following text: A lesser setback distance may be used if a qualified and licensed professional engineer specifies in writing that the collapse of the proposed tower will occur within a lesser distance. SECTION 2. ORDINANCE SUMMARY FOR PUBLICATION The following is the official summary of Ordinance #01 , which has been approved by the City Council of the City of Ramsey as clearly informing the public of the intent and effect of the ordinance: Section 9.15.08, Tower Setbacks, has been modified to clarify required setbacks for commercial towers located in Business and Industrial Zoning Districts, to require that commercial towers be setback 1.5 times the height of the tower from any lot line in residential districts, and to remove -199-
