!

I

I

REQUEST FOR A CONDITIONAL USE PERMIT
TO MAINTAIN HORSES ON LESS THAN THREE ACRES:
CASE OF THERESA DAHLHEIMER
By: Sylvia Frolik, Community Development Director

CASE #

Background:

On February 28, 2000 the City received a complaint that the property owners at 8820
181st Avenue are exceeding the number of permitted horses on their property. The City
conducted an inspection of the property on March 16, 2000 and saw two horses on the
subject property. Staff verified the parcel to be 2.5 acres in size. City Code states that a
maximum of 2 horses are. allowed on parcels between 1.5 and 3 acres in size with a
conditional use permit. The property file did not-reflect an issuance of a conditional use
permit. Therefore the City sent notification on April 11, 2000 to the property owners
stating that there was a violation of Ramsey City Code and gave solutions to remedy the
violation.

Theresa Dahlheimer contacted the City and stated that she' does have 4 horses and owns
2.5-acres, but is also renting approximately 4 + acres from a neighbor. Ms. Dahlheimer
is requesting a conditional use permit to maintain a total of four horses on less than 3
acres based on the fact that she rents approximately 4 acres from a neighbor, for a total of
6.5 acres. If she owned all 6.5 acres, 4 horses would be a legal number. The subject
property is located at 8820 181st Avenue and the applicant is renting property located at
8840 181st Ave.

The following information is enclosed for your review:

a) Site Location Map
b) Site Plan
c) Letter of Application
d) Letter to the Applicant dated April 11, 2000
e) Statement from Theresa Dahlheimer regarding leased property
f) Letter to Theresa Dahlheimer explaining complaint dated October 24, 2000
g) Letter fi'om Greg Matuseski dated January 15, 2001
h) Draft Horse Board meeting minutes dated January 17, 200t
i) Letters from John Enstrom and Ken Dehn, Jr. dated February 5, 2001 and Janelle
McCollum dated February 6, 2001, expressing opposition or concern with the
requested permit
j) Draft Planning Commission meeting minutes dated February 6, 2001
k) Proposed findings of fact
1) Proposed Conditional Use Permit

¸61
