BOARD BUSINESS ~, :~ ~:.~i!~!%~ <br /> <br />Case #1: Request for a Conditional Use Permit to Maintain Horses on Les~,:~an Three <br /> Acres; Case of Theresa Dahlheimer <br /> <br /> Community Development Assistant Wald stated that on February 28, City a <br /> telephone complaint that the property owners of 8820 181~t Avenue were e~X~"~ng the'l: <br /> number of horses on their property.. The City conducted an inspectiom:of the~is~p~erty on <br /> 16, 2000 and saw two horses on the subject property. Staff verifi~size ;~Fi~t~e parcel to <br /> 2.5 acres in size. City Code states that parcels between 1.5 anithree acr~.m s~ze are allowed to <br /> mmntmn two horses wxth a cond~tmnal use permit ~ssued b~7~C~ty. The property file d~d not <br /> reflect an issuance of a conditional use permit, therefor~tti~City sen[:~otification, on April 11, <br /> 2000 to the property owners informing them that th in violat Ramsey City Code <br /> and gave solutions to remedy the violation. Theredi~imer conta~"~:he City and stated <br /> that she does own 2.5 acres and is also renting appr6~kmat~:324 affre~:+fro~":~ neighbor. Staff <br /> believes that this property owner does not currently own ang::hoi:ses. Ms. Dahlheimer is <br /> requesting a conditional use permit to maintain a total of four h6m"~s., on less than three acres <br /> based on the fact that she rents 3.4 acres from a neighbor, for a total~:~5.9 acre~~ The subject <br /> property xs located at 8820 181 Avenue: ...... ~ and the apphcant xs rentxng pr-op~: ~located at 8840 <br /> 181 ~ Avenue. The applicant mov~it0!~, ~e~Gi~ of Ramsey in 1984 anc[:h~' been maintaining <br /> horses on the property since :t~en;:" Th~ surr°~i:Ii~:.'~cels range in:i:s~e from 2.5 acres to <br /> approximately ten acres and most prop~ owners in~th~ea:3wn hbrses The horse ordinance <br /> that was in effect in t984 when the appliE~ mo~..~o~'the Ci~¢i0~;Ramsey required residents to <br /> own three acres per horse. Current City Code would allow seven horses <br />on a 5.9 acre parht:~f:tlqe applicant ow~ ihe entire acreage, four under the proposed amendment <br />~.:~2(SC~[. in review:~ :~.manure produced by the horses is dispersed to surrounding neighbors <br />~¢'(-~}~:~:*'"an~f'}:~on the subj';~op~; City Code requires barns to be set back a distance of 50 feet <br />from dweI. l~ngs and 75 feel. from:Property lines. The 2.5 acre parcel contains a 30 foot by 55 foot <br />(1,650 squar-e, feet) barn tha~- located approximately 64 feet from the nearest property line. The <br />applicant alsos.'~ a r°~d pen area for the horses on the 2.5 acre parcel. It 'is staff's <br />understanding !that~ the horses have been maintained on the 2.5 acre parcel since 1980. <br />Maintaining hd~k~s on the property is compatible with the characteristic of the neighborhood and <br />'~:.:::?:9onsistent w~i~ffiS~urrounding uses. Staff recommended approval of the conditional use permit <br />'~?)~ontingent~::~6n. the applicant providing verification that 3.4 acres is being, leased from the <br />:art}~enri~ghbor. However, the permit should specify that if the lease is terminated, the <br />ap~Sdan{~'must remove two horses from the property to comply with City Code restrictions of <br />tw6; h3rses on 1.5 to three acres.
