I
I
!
I
I
I
I
l
I
I
I
I
I
I
I

6 February 2001

City of Rantsey .
1.5153 Nowthtm Boulevard N.W.
Ramiey Minnesota 55303

Conditional Use Permii Application, Theresa Dahlheimer

Please consider our comnmnts regarding the application of Theresa Dalhiemer requesting a Conditional
Use Permit which would allow her to maintain horses on her property.

We own the 6.8 piece of property behind Mark and Theresa D~lheimer's residence and are former
neighbors having owned the proper%, now owned by the Sw~,nson's. On two occasions we had a si§ned
agrmunent for them to purchase the 6.g acre property. Both times, the agreements fell through due to
insufficient funds.

We feel that Theresa does take good care of her horses and would-not want to do anything to hinder her
chances of keeping her horses on the property but also feel that we need to protect our interests in our
property. We feel that she should be allowed to keep 2 horses on her own property, We have reservations
about allowing her to lea.se acreage in order m have mare than 2 horses on the property. The main reason
for this is because of the length of the agreement which we understand extends to a new owner of the
property should Mark and Theresa sell. I understand there are other conditions which would void the
agreement if they are not md and would like to have the ownership of the property be one of them.
Therefore il' Mark and Thersa should sell, the agreement would be voided. And likewise if the people
lea~ing the property m them (I assume C-rag Matuseski) should se. Il, it would void the conditional use
permit.

Several years ago we gave Mark & Theresa permission to run a fence across a corn~' of our 6.8 parcel
allowing access to the leased land but ~ked them to remove the fence when we had the property for sale.
We have not been able to visually impect the fence to make sure it is not encrouching our property and
therefore can not endorse such an agreement at this time.

Additionally, we have res~vafions about manure and other mfme being dumped on our 6.8 acre property
as it has been done in the paxt and are concerned that thi~ practice may be continuing without our
knowledge.

We also have concerns that the Dahlheimer's barn is situated too close m the Swanson's proper~y line and
are mentioning this because we have an agreement for a road easement with the Swanson's in order to get
back to the 6.8 parcel of property. I believe they are violating City Code of being 75 f~t from propm'ty
lines with their barn.

We will not be able to attend the Planning and Zoning meeting be/rig ~eld this evening a~d would likt~ to
request minutes of ~he meeting. Could you let me know when these minutes would be available? I can be
reached at 763-572-7007 during the day.

Thank you,

Carl McCollum

-77-
TnT~I_ P.Ot
