-82- <br /> <br />10. <br /> <br />1I. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br /> 16. <br /> <br />1T <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />That Section 5.09.05 (Horses) of the Ramsey City Code allows two horses on property that is <br />less than three acres in size with the issuance of a Conditional Use Permit. <br /> <br />That Section 5.09.05 (Horses) does not address how leased property affects the number of <br />horses a property owner is permitted to maintain. <br /> <br />That if the Applicants owned the entire 6.5 acres they would be allowed to maintain a total of <br />nine (9) horses. <br /> <br />That the Applicant is proposing to maintain a maximum of four (4) horses on property that <br />contains 2.5-acres of owned land and 4 acres of leased property. <br /> <br />That.a fenced path connects the Subject Property and the leased pasture area in order to allow <br />the horses to roam between the two properties. <br /> <br />That the Applicants have stated that the manure production is dispersed to surrouriding <br />neighbors and spread on the owned and leased land. <br /> <br />That the Subject Property contains a 30-foot by 55-foot (I,650 square foot) barn and is <br />located approximately 64-feet from the nearest property line. <br /> <br />That if granted, the conditional use permit is an attempt to gain control of a non-conforming <br />situation that has existed since 1984 and shall not be deemed a precedent to allow leased <br />acreage to count as acreage towards the number of permitted horses a property owner can <br />maintain. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the' proposed use will not be unduly dangerous or otherwise detrimental .to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br />That the proposed use will not be hazardous to existing or future neighboring uses. <br /> <br />That the proposed use will be served adequately by Public facilities and services such as <br />highways and streets. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services, and it will not be detrimental to the economic welfare of the <br />community. <br /> <br />RESOLUTION #01-02- <br />Page 2 of 3 <br /> <br />I <br />I <br />I <br /> <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
