Councilmember introduced the following resolution and moved for its adoption: -84- RESOLUTION #01-02- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO MAINTAIN FOUR HORSES ON PROPERTY THAT CONTAINS 2.5-ACRES OF OWNED AND 4-ACRES OF LEASED LAND. WHEREAS, the Ramsey City Council adopted Resolution #01-02- adopting Findings of Fact # to maintain four (4) horses on property that contains 2.5-acres of owned and 4-acres of leased land and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On February 27, 200I, a Conditional Use Permit ("Permit") was issued by the City of Ramsey ("City") to Mark and Theresa Dahlheimer ("Permit-tees") to maintain four horses on less than the required acreage on the property generally known as 8820 181st Avenue and legally described as follows: The North 363 feet of East 300 feet of Northeast quarter of Northeast quarter of Section 6, Township 32, Range 25, except road subject to easement of record, Anoka County, Minnesota ("Subject Property"). This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this Permit are as follows: 1. This Permit shall remain in effect so long as the terms contained herein are complied with. 2. This Permit shall allow for the maintenance of a maximum of four (4) horses on the Subject Property plus 4-acres of leased land. 3. The Permittees shall provide verification annually that they are leasing approximately four (4) acres of pastureland from Mr. Mamseski the adjacent neighbor to the west. 4. The Permit-tees agree that in the event the lease for additional pasmreland is terminated, the number of permitted horses on the Subject Property shall be reduced too two (2). 5. That the fee title owner of the land to be leased to the Permittees herein agrees that the calculation for number of horses allowed on his/her property is decreased by four (4) acres.
