Councilmember introduced the following resolution and moved for its adoption: <br /> <br />-84- <br /> <br />RESOLUTION #01-02- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />MAINTAIN FOUR HORSES ON PROPERTY THAT CONTAINS 2.5-ACRES OF <br />OWNED AND 4-ACRES OF LEASED LAND. <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution #01-02- adopting <br />Findings of Fact # to maintain four (4) horses on property that contains 2.5-acres of owned <br />and 4-acres of leased land and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On February 27, 200I, a Conditional Use Permit ("Permit") was issued by the City of Ramsey <br />("City") to Mark and Theresa Dahlheimer ("Permit-tees") to maintain four horses on less than the <br />required acreage on the property generally known as 8820 181st Avenue and legally described as <br />follows: <br /> <br />The North 363 feet of East 300 feet of Northeast quarter of Northeast quarter of <br />Section 6, Township 32, Range 25, except road subject to easement of record, <br />Anoka County, Minnesota <br /> <br />("Subject Property"). <br /> <br />This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br />1. This Permit shall remain in effect so long as the terms contained herein are complied with. <br /> <br />2. This Permit shall allow for the maintenance of a maximum of four (4) horses on the Subject <br /> Property plus 4-acres of leased land. <br /> <br />3. The Permittees shall provide verification annually that they are leasing approximately four <br /> (4) acres of pastureland from Mr. Mamseski the adjacent neighbor to the west. <br /> <br />4. The Permit-tees agree that in the event the lease for additional pasmreland is terminated, the <br /> number of permitted horses on the Subject Property shall be reduced too two (2). <br /> <br />5. That the fee title owner of the land to be leased to the Permittees herein agrees that the <br /> calculation for number of horses allowed on his/her property is decreased by four (4) acres. <br /> <br /> <br />
