-84- 6. LIGHTING. Any lighting installed on the Structure shall be designed to deflect light away from 149th Avenue N.W. and is subject to the approval of the City Engineer. 7. SIGNS. Signs erected on the property shall be in conformance with the covenants for Pineview Estates 2nd Addition Planned Unit Development. 8. DRAINAGE. It is the Permittee's responsibility to ensure that the design of the driveway along the east property line shall not obstruct existing drainage patterns. The Permittee also herein accepts full responsibility for adequate drainage away from the Structure. 9. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY. No building permit for the Structure will be issued until: 1) the Permittee has signed and returned this Development Permit; 2) the escrow requirements of Paragraph 10 below have been satisfied; 3) the Permit-tee has reimbursed the City for all expenses incurred in approval of the site plan, No Certificate of Occupancy for the Structure will be issued until: 1) the Required Improvements are accepted by the City or a financial surety for same is in effect at the City; 2) the Permittee has reimbursed the City for all expenses incurred during the construction of the Required Improvements. 10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be constructed and installed on or before April 1, 2002. 11. ESCROW. In order to insure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit approved by the City in the amount of Ten Thousand Dollars and no cents ($10,000,00), which is 150% of the City's estimated cost of the Required Improvements. Upon completion of the construction of the Required Improvements, as certified by the City Engineer, the escrow shall be returned to the Permittee. In the event the Permittee fails to construct and install the Required Improvements as required herein, the City may complete the Required Improvements with City day labor and/or by letting contracts for said completion and draw upon the escrow for payment. Permittee hereby grants permission and a license to the City and/or its contractors and assigns to enter upon the Site for the purpose of completing the construction and installation of the Required Improvements in the event of the Permittee's default. Ronald Johnson hereby acknowledges receipt of this permit and that he has reviewed the conditions of this permit and has agreed that he will comply with the terms of this permit.
