-84- <br /> <br />6. LIGHTING. Any lighting installed on the Structure shall be designed to deflect <br />light away from 149th Avenue N.W. and is subject to the approval of the City Engineer. <br /> <br />7. SIGNS. Signs erected on the property shall be in conformance with the covenants <br />for Pineview Estates 2nd Addition Planned Unit Development. <br /> <br />8. DRAINAGE. It is the Permittee's responsibility to ensure that the design of the <br />driveway along the east property line shall not obstruct existing drainage patterns. The <br />Permittee also herein accepts full responsibility for adequate drainage away from the <br />Structure. <br /> <br />9. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Structure will be issued until: 1) the <br />Permittee has signed and returned this Development Permit; 2) the escrow requirements <br />of Paragraph 10 below have been satisfied; 3) the Permit-tee has reimbursed the City for <br />all expenses incurred in approval of the site plan, No Certificate of Occupancy for the <br />Structure will be issued until: 1) the Required Improvements are accepted by the City or a <br />financial surety for same is in effect at the City; 2) the Permittee has reimbursed the City <br />for all expenses incurred during the construction of the Required Improvements. <br /> <br />10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required <br />Improvements shall be constructed and installed on or before April 1, 2002. <br /> <br />11. ESCROW. In order to insure the installation of the Required Improvements in <br />accordance with City specifications and in a timely manner, the Permittee shall be <br />required to deposit with the City a cash escrow or letter of credit approved by the City in <br />the amount of Ten Thousand Dollars and no cents ($10,000,00), which is 150% of the <br />City's estimated cost of the Required Improvements. <br /> <br />Upon completion of the construction of the Required Improvements, as certified by the <br />City Engineer, the escrow shall be returned to the Permittee. In the event the Permittee <br />fails to construct and install the Required Improvements as required herein, the City may <br />complete the Required Improvements with City day labor and/or by letting contracts for <br />said completion and draw upon the escrow for payment. Permittee hereby grants <br />permission and a license to the City and/or its contractors and assigns to enter upon the <br />Site for the purpose of completing the construction and installation of the Required <br />Improvements in the event of the Permittee's default. <br /> <br />Ronald Johnson hereby acknowledges receipt of this permit and that he has reviewed the <br />conditions of this permit and has agreed that he will comply with the terms of this permit. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
