CASE <br /> <br />By: <br /> <br />ADOPT RESOLUTION APPROVING <br />APPRAISAL FOR ACQUISITION OF <br />153~'d/155th RIGHT OF WAY <br /> William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />The City Council by Resolution 00-10-266 authorized the commencement of an eminent domain <br />action for acquisition of RIGHT OF WAY from Reginald Vasseur, owner of a parcel necessary for <br />the construction of the 155th Ave. N.W. extension. As a part of that condenmation process an <br />appraisal has been completed. The appraiser has determined the value of the Vasseur parcel to be <br />$61,605.00. The Vasseur parcel does include the necessary right of way and an extensive wetland <br />area for a total size of 41.07 acres. This then is the amount which the City will need to offer the <br />land owner for title to the parcel. The land owner has the option of accepting the appraisal amount <br />or going forward with the condenmation process including' commissioners hearings as well as a <br />Disthct Court trial. The final amount paid to the parcel owner could therefore be more than the <br />$61,605.00 if so determined by the commissioners and/or District Court Judge. <br /> <br />In order for the City to acquire title to the parcel now we must deposit the $61,605.00 with the <br />District Court or pay it to the owner at the owner's discretion.
