Case

REQUEST FOR CONSIDERATION FROM
NORTH LAKE PROPERTIES, INC.
By: James E. Norman, City Administrator

Background:

The Public Works Committee considered a request from Wayne Johnson, representing North
Lake Properties, Inc., during the meeting of February 20, 2001 (both requests attached). The
case included a great deal of background information and correspondence between the City and
Mr. Johnson (Committee Cover Sheet attached). The Committee was to consider a request by
Mr. Johnson to be reimbursed for fees and costs in connection to the construction of Ramsey
Towne Square at 14050 St. Francis Boulevard. Mr. Johnson requested a return of $7,974 in
trunk charges and that an additional $3,930 be returned for the cost of capping the four-inch
service line to his project. The Committee decided to recommend refusal of the four-inch service
cap during the meeting of February 20, 2001, however, held over the decision of the trunk charge
development fee for City Attorney review.

Bill Goodrich has completed his review of the trunk charge development fee and has determined
that the development fee was correctly charged.

Recommendation:

The Public Works Committee would recommend denial of both requests by Wayne' L. Jotmson
of North Lake Properties, Inc.

Council Action:

Motion to deny both requests by Wayne L.
