Motion by Commissioner Kociscak, seconded by Commissioner Reeve, to recommend that City
Council approve the site plan for Orchard Hills contingent upon compliance with City Staff
Review letter dated December 5, 2000.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Reeve, Griffiths, and
Wivoda. Voting No: None. Absent: Commissioner Johnson.

Case #4:

Request to Rezone Certain Property from B~I Business to B-2 Business;
Case of RI* Development and Lyndale Terminal Company

Chairperson Nixt closed the regular portion of the Planning Commission meetingat 8:42 p.m. in
order to conduct the public hearing. ..

Public Hearing

Chairperson Nixt called the public hearing to order at 8:42 p.m.

Presentation

Community Development 'Assistant Wald stated that RF Development LLC and Lyndale
Terminal Company are requesting to rezone the northerly portion of Outlot C, River's Bend 3ra
Addition from B-1 to B-2 Business to facilitate development of the property with a convenience
store with gas. The applicants are proposing to develop a Holiday Station convenience and
gasoline store on the northerly 1.4 acres of Outlot C, River's Bend 3~ Addition. The remainder
of the property woul3 retain the B-1 Business zoning. The 1.4 acre parcel is surrounded by a
variety of zoning districts: commercial, multi-family residential, and single, family residen{ial.
The B-1 Business zone allows for convenience stores, the B-2 zone allows for convenience stores
with gasoline sales. Historically, the subject property has been zoned for commercial uses for 20
years. Likewise, it has been a very long time, at least ten years, since'the "Permitted Uses" have
been reviewed in the commercial zoning districts and may be out of sync with the current
market. The vast majority of today's convenience stores include gasoline sales. City staff
recommends approval of the proposed rezoning.

Citizen Input

Ron Nieto, 5021 143rd Lane NW, Ramsey, stated that he opposed the Holiday station because the
increase in the amount of traffic. He is concerned that it will be unsafe for his children.

Chairperson Ni6tt inquired as to what the permitted uses are in the B-1 zoning.

Community Development Director Frolik explained that B-1 and B-2 are very similar, but the B-
2 allows for the gasoline sales.

Planning Commission/December 5, 2000

-163-
