I <br />I <br /> <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Councilmember introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #01-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED THE DETACHED ACCESSORY BUILDING HEIGHT RESTRICTION <br />FOR PROPERTIES LOCATED WITHIN THE METROPOLITAN URBAN SERVICE <br />AREA (MUSA) BASED ON FINDINGS OF FACT # AND DECLARING TERMS <br />OF SAME: <br /> <br /> WHEREAS, Jeff and Michelle Hansen have properly applied for a conditional use <br />permit to exceed the detached accessory building height restriction for properties located within <br />the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" <br />of City Code on the property generally known as 6250 - 152nd Avenue NW and legally described <br />as follows: <br /> <br />Lot 1, Block 2, Fox Knoll 2nd, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on April 3, 2001, conducted the <br />public hearling and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # ., a conditional use permit (Permit)to exceed the <br />detached accessory building height restriction for properties located within the MUSA as <br />established in City Code, is hereby granted to Jeff and Michelle Hansen, hereinafter referred <br />to as the "Permittees" <br /> <br />That the detached accessory building may exceed the sixteen (16) foot detached accessory <br />building height restriction for properties located within the Metropolitan Urban Service Area <br />by a total of 2 feet 2 inches in order to match the design and height of the attached accessory <br />building. <br /> <br />That the co~tmction of the detached accessory building on the Subject Property shall requh:e <br />issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes. <br /> <br />The Permittees herein agrees that a business will not be operated in the detached accessory <br />building unless it is in accordance with City Code. <br /> <br />-107- <br /> <br /> <br />
