During the public hearing the <br />Applicant stated that they had some concerns regarding the City constructing an equipment <br />building to facilitate all cellular providers. Equipment buildings are constructed to be <br />electronically climate controlled in order to house radio controlled equipment. Verizon Wireless <br />also stated some concern regarding security as they are not comfortable placing their equipment <br />in an area that is accessible to others and they would need to have access to the building monthly <br />for regular equipment checks. Mr. Nelson stated that they also have a few concerns related to' <br />installing temporary equipment structures as it will be extra time, cost, and work for them, <br />however they are were willing to work with the City. <br /> <br />Subsequent to the Planning Commission meeting, the Applicant submitted a landscaping plan <br />that meets City standards. The landscaping plan is providing adequate screening from the <br />proposed residential development by Royal Oaks Reality. It is Staff's recommendation that the <br />lease agreement contain language regarding who will be responsible for the perpetual <br />maintenance of the area surrounding the equipment building and the landscaped yard. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommends approval of the request contingent upon an approved <br />landscape plan, the fence being constructed out of materials that will provide reasonable <br />screening from surrounding properties, the City entering into a lease agreement with Verizon <br />Wireless, also, that the lease agreement contain language reserving the City's right to require <br />Verizon Wireless to relocate, on suitable terms, their equipment into a City owned structure if the <br />City determines that to be the preferred development plan for the site. <br /> <br />Subsequent to the Planning Commission meeting, Staff had a very informative conversation with <br />Mr. Garret Lysiac, and Staff is recommending that Mr. Lysiac be retained to address the City <br />Council's technical questions and assist the City in developing some basic standards for leasing <br />City property for telecommunication purposes. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #01-04-~ adopting Findings of Fact # relating to a request <br />from Verizon Wireless for a conditional use permit to install a cellular antenna system on the <br />City water tower and construct an equipment building on City owned property. <br /> <br />-and- <br /> <br />Motion to adopt Resolution #01-04 approving the request for a conditional use permit to <br />install a cellular antenna system on the City's water tower and construct an-equipment building <br />on City owned property contingent upon the placement and size of the equipment building be at <br />Staff' s discretion utilizing the expertise of a consultant, and adopt a resolution declaring terms of <br />same. <br /> <br />-179- <br /> <br /> <br />
