I <br /> <br /> I <br /> I <br /> I <br /> I <br />! <br /> I <br /> ! <br /> I <br />I <br /> I <br /> I <br />:1 <br /> I <br /> I <br /> I <br /> <br />CASE # <br /> <br /> REQUEST FOR EXTENSION TO RECORD FINAL PLAT FOR <br />RIVER PINES 4TM ADDITION AND AMENDMENT TO DEVELOPMENT <br />AGREEMENT FOR RIVER PINES 3Rn ADDITION; <br /> CASE OF ORRIN THOMPSON HOMES <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On May 12, 1998, the Ramsey City Council granted final plat approval to Apple Ridge 2nd, 3rd, <br />4th and 5th Additions being developed by Good Value Homes. Subsequently, the property was <br />sold and US Home Corporation or Orrin Thompson Homes assumed the obligations of the <br />development agreements. US Home requested a plat name change and recorded the second <br />phase of Apple Ridge as River Pines and the 3ra phase of Apple Ridge as River Pines 2na <br />Addition. Accordingly, the 4th and 5th phases of Apple Ridge will be recorded as River Pines 3ra <br />and River Pines 4th Additions. <br /> <br />Observations: <br /> <br />City Code establishes a 2 year time frame from the date of final plat approval to record a plat at <br />the County. In 2000, the City Council granted a one year extension to May 12, 2001, to the <br />recording of the final two phases of River Pines. River Pines 3rd Addition will be recorded by <br />May 12. However, River Pines 4th Addition is not on a timeline to be recorded by May 12. <br />Orrin Thompson Homes has submitted a written request for an additional 6 month extension in <br />which to record the final phase of River Pines. <br /> <br />City Code states that "the Council may extend the period upon written application by the <br />subdivider and subject to all applicable performance conditions and requirements, or the Council <br />may require submission of a new application unless the Council finds that substantial activity <br />and investment has occurred in reasonable reliance on the approved application and the <br />subdivider will suffer substantial financial damage as a consequence of a requirement to submit a <br />new application." <br /> <br />A copy of the approved final plat for River Pines 4th Addition is enclosed for your information, <br />along with a proposed resolution for a 6 month extension. In conjunction with the extension for <br />recording, the deadline for installing the Stage I Improvements in Item #6 of the Development <br />Agreement also needs to be modified. Given that the extension to recording is at the end of this <br />construction season, Staff is recommending amending the completion date to the end of next <br />year's construction season or November 30, 2002. <br /> <br />Also, Staff and, the Developer are currently working on recording the plat and development <br /> · Pines 3 Addition by the May 12 deadline. At the time the extension was <br />agreement for River rd <br /> <br />granted, Staff erroneously did so without amending the deadline for installing the Stage I <br />Improvements in that phase. However, there is still time to do that and record the development <br />agreement by May 12. Staff is requesting Council approval to change the improvement <br /> rd <br />construction deadline for River Pines 3 Addition to the end of this year's construction season or <br />November 30, 200.1. <br /> <br />-201- <br /> <br /> <br />
