Certificate of Survey, including that survey information required by the CITY has been supplied to the City Building Official; and (c) all the financial guarantees required by the CITY have been satisfied.~ No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the lot is provided including the installation of Class V material on all streets in the Plat; (b) all utilities are in place, operational and accepted by the CITY; and (c) boulevard sod and landscape tree, or escrow for same, have been provided. SECTION IV PARK DEDICATION Cash Contribution. The Plat is located in the Oak Park District. Park dedication requirements shall be satisfied by a cash payment in the amount of Twenty Six Thousand Two Hundred Fifty Dollars and no cents ($26,250.00) (30 lots x $875.00 per lot). This payment shall be made to the City prior to the release of the Final Plat for recording. SECTION V TRANSPORTATION AND LANDSCAPING Park Trail Development Fee. The City Council has enacted a trail development fee in the amount of One Hundred Dollars and no cents ($100.00) per lot. Therefore, a payment in the amount of Two Thousand One Hundred Dollars and no cents ($2,I00.00) (21 lots x $100/lot) is due at the City prior to releasing the Final Plat for recording. Tree and Sod Planting Plan. If the Stage II boulevard seeding has not established, sodded boulevards, in addition to a front yard tree, are a requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. The DEVELOPER is required to submit a Landscape Plan for CITY approval that identifies existing tree growth within the Plat that will be preserved during construction and new plantings. The requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: Minimizing tke impact of construction on' trees in accordance with Minnesota Extension Service publication "Protecting Trees From ConstruCtion Damage" (Publication ~rNR-FO-6135-S). b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lot in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or planting sod in the boulevard at the time of Certificate of Occupancy, the BuiJ. ding Permit holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verification of the planting being accomplished, said cash deposit shall be refunded to the Building Permit holder. Failure of the Builder to comply with the planting requirement within a reasonable time frame following a determination by the CITY that weather conditions are conducive to planting shall give the CITY authority to cause the I I I I I I I I I I I I I I I I I I
