-134- Board Member Kociscak introduced the following resolution and moved for its adoption: RESOLUTION #01-05- A RESOLUTION ADOPTING FINDINGS OF FACT # REQUEST FOR A VARIAaNCE TO THE HEIGHT BUSINESS WAREHOUSE DISTRICT. RELATING TO A RESTRICTIONS IN A WHEREAS, Old Castle Precast, hereinafter referred to as "Applicant", has requested a variance from building height restriction established in City Code in order to allow for operation of equipment (the "Structure") on the property legally described as follows: The East half of Southeast quarter of Southwest quarter of Section 27, Township ~'~ ~=, Range 25,except that part described as follows: Commencing at Northwest coruer of said East half, thence South along west line of said East half 409.44 feet to point of beginning, thence East at right angle 11 feet, thence South at right angle 264 feet, thence West at fight angle to West line of said East half, thence North along said West line to point of beginning, except road subject to easement of record, Anoka County.', Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the Ramsey City, Code on May 1, 2001 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the property, is zoned BW Business Warehouse. 3. That the Business District regulations restrict structure heights to 35 feet. That the Applicant is proposing a manufacturing facility expansion on the Subject Property that will inarease the roofline to 44-feet and therefore exceeds the 35-foot height restriction by 9~feet. 5.
