The dwelling constructed on Lot 2 and any future <br />accessory buildings on Lot 1 or 2 shall be sited on the lots with setbacks in accordance <br />with the underlying zoning district as if the 66 foot wide drainage and utility easement <br />traversing the Subject Property in a north/south direction and the 33 foot wide drainage <br />and utility easement in the southeast comer of the Plat were improved, public streets. <br /> <br />Drainage and Utility Easements. The standard 10 foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two lots. The corridors for the future extension of Eland Street from north to south <br />through the Plat and 157th Avenue N.W. from the southeast comer of the Plat, west to <br />"T" into the future Eland Street N.W., shall also be preserved by drainage and utility <br />easement. <br /> <br />Resubdivision Restrictions. Under 4 in 40 density regulations and a variance to same <br />granted by the City of Ramsey Board of Adjustment on December 5, 2000, it is herein <br />agreed that the Plat, based on the underlying legal description, is limited to a total of two <br />(2) lots and no further resubdivision of any lot in the Plat will be permitted until sanitary <br />sewer and municipal water are available to the Subject Property or the repeal or reduction <br />of the 4 in 40 density restrictions. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. The Plat is in the Lake Itasca Park District. The DEVELOPER shall <br />satisfy the park dedication requirement for the Plat with land for a trail corridor along the <br />south boundary of the Plat. Said trail corridor shall be dedicated on the final plat as a <br />linear park from the west side of the 66 fogt drainage and utility easement to the west plat <br />boundary; the remainder of the trail from the east side of-the 66 foot wide drainage and <br />utility easement to the east plat boundary shall be conveyed to the City as a recordable <br />eaasement for trail purposes over the 33 foot wide drainage and utility easement in the <br />southeast comer of the Plat. <br /> <br />Trail Development Fee. The City Council has enacted a trail development fee in the <br />amount of Three Hundred Twenty Five Dollars and no cents ($325.00) per lot. Lot 1, the <br />existing homestead, is exempt from this fee. Therefore, a payment in the amount of <br />Three Hundred Twenty Five Dollars and no cents ($325.00) is due at the City prior to <br />releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />in the amount of Three Hundred Seventy Five Dollars and no cents ($375.00) per unit. <br />Lot 1, the existing homestead, is considered by the CITY to be exempt from this fee. <br />The amount of Stormwater Management Fee due on the Plat is Three. Hundred Seventy <br />Five Dollars and no cents ($3756.00). This obligation must be fulfilled prior to the CITY <br />releasing the Final Plat for recording. <br /> <br />-191- <br /> <br /> <br />
