Stat. § 117.001 and § 117.042; <br />and <br /> <br /> WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and possession of the Subject Property prior to the filing of an award by the Court Appointed <br />Commissioners; and <br /> <br /> WHEREAS, the property owner of the Subject Property and the Anoka County PIN for <br />the said property have been identified by the City as follows: <br /> <br />PIN <br />28-32-25-13-0001 <br /> <br />IFEE OWNER <br /> B.M.A. Associates, a <br /> Minnesota Partnership <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. In order to carry out the purposes and objectives described above it is necessary to <br /> acquire the Subject Property. <br /> <br />The acquisition of the Subject Property by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to <br />be necessary. <br /> <br />o <br /> <br />The City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. §117.042 to pay to the owners or into court a sum of money to <br />serve as compensation to the owners of the Subject Property, which amount shall be <br />equal to Petitioner's approved appraisal of value as determined by the City. <br /> <br />That the City Administrator is hereby directed to acquire the Subject Property as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />attthorized to negotiate and represent the City of Ramsey in all proceedings.' <br /> <br />5. That if the Subject Property cannot be acquired by direct negqtiation, it shall be <br /> acquired by eminent domain. <br /> <br />o <br /> <br />That the City Council hereby authorizes acquisition of the Subject Property by <br />eminent domain and to take title and possession of that land prior to filing of an <br />award by the Court Appointed Commissioners pursuant to Minn. Stat. §117.011 and <br />§ 117.042. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br /> <br />RESOLUTION #01-05~ <br />Page 2 of 3 <br /> <br />-203- <br /> <br /> <br />
