CASE # <br /> <br />CONSIDER ORDIN.aXNCE TO AMEND GR_@ING REGULATIONS <br /> By: Principal Planner Patrick Trudgeon <br /> <br />Background: <br /> <br />The Public Works Committee has been working with City Staff regarding issues dealing with <br />grading of residential tots. The Committee instructed the staff to identify and propose language <br />to rectify current problem areas. They also instructed staff to bring these issues to the Planning <br />Commission for a public heating and discussion. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />Draft Minutes of the April 3, 2001 Planning Corrm'tission Meeting <br />Excerpt of City Code with strikethrou~as and underlines to identify proposed <br />changes to the text. <br />Proposed ordinance <br /> <br />Observations: <br /> <br />The proposed ordinance addresses several areas of concern. Specifically, they are as follows: <br /> <br />Require an elevation survey at the time of a footing and foundation inspection for new <br />construction. This will ensure that the elevation of the foundation con_forms to the overall <br />gading plan of the area. This requirement may be waived at the discretion of the City <br />En~neer if it is determined that the elevation survey is not needed to ensure the compatibility <br />of the ~ade of the lot with the overall area. <br /> <br />· A property owner shall not modify the sade of an existing lot that has an approved ~ading <br /> plan except after review and approval by the City, Engineer. <br /> <br />Allow for residents to create a pond without receiving a conditional use permit provided that <br />the new pond has a water surface of less than one-third of an acre. At your April 3ra meeting, <br />the Planning Commission raised concern regarding this provision. To limit the possibility of <br />having a large pond being constructed without review by the City, staff has added language <br />that states that a C.U.P will not be required when constructing ponds with a water surface of <br />less than one-ttfird of an acre or having a surface area of less than 20% of the lot size, <br />whichever is less. <br /> <br />· Grades less than I% shall not be allowed, tf a ~rade is proposed to be less than 2%, a <br /> cert/ficate of ~ading will be required prior to occupancy. <br /> <br /> Irurrher review of the ordinance by staff indicated that one additional change should be brought <br /> forward at this time. Currently, a ~ading permit requires a conditional use permit with a tlzree <br /> year term limit.
